Responder Immunity definition

Responder Immunity means the limited immunity from liability provided by Section4201(a) of OPA (33 U.S.C. Section1321(c)(4)), or any other similar limitation of liability with a similar effect and scope under any other form of international, foreign, Federal, state, local, or other law (those jurisdictions MSRC has identified as having such a limitation of liability are identified on Schedule 4, as it may be amended by written notice from MSRC to the COMPANY).
Responder Immunity means the limited immunity from liability provided by Section 4201(a) of OPA (33 U.S.C. Section 1321(c)(4)), or any other similar limitation of liability with a similar effect and scope under any other form of international, foreign, Federal, state, local, or other law. In the case of the use of alternative response technologies, the COMPANY represents and warrants that it has complied and will continue to comply with all applicable laws relating to such use including, without limitation, obtaining all necessary approvals from Governmental Bodies for such use.

  • Regulatory Proceeding means a request for information, civil investigative demand, or civil proceeding commenced by service of a complaint or similar proceeding brought by or on behalf of the Federal Trade Commission, Federal Communications Commission, or any federal, state, local or foreign governmental entity in such entity’s regulatory or official capacity in connection with such proceeding.

  • EXPERIMENTAL OR INVESTIGATIONAL means any healthcare service that has progressed to limited human application, but has not been recognized as proven and effective in clinical medicine. See Experimental or Investigational Services in Section 3 for a more detailed description of the type of healthcare services we consider experimental or investigational.

In determining whether a Respondent is a Responsible Respondent, the Agency may consider various factors including, but not limited to, the Respondent’s competence and qualifications to provide the goods or services requested, the Respondent’s integrity and reliability, the past performance of the Respondent and the best interest of the Agency and the State.

  • Tax Filing Authorised Person means such person as any Director shall designate from time to time, acting severally.

  • Rule 506(d) Related Party means, with respect to any Person, any other Person that is a beneficial owner of such first Person’s securities for purposes of Rule 506(d) under the Securities Act.
