Royalty Bearing Territory definition

Royalty Bearing Territory means (a) with respect to Co-Developed Products, all countries outside of the Co-Development Territory and (b) with respect to Products, all countries within the Territory.

Royalty Bearing Territory means all countries and jurisdictions in the Territory; provided, however, that in the event that Ambit exercises the Co-Promotion Option pursuant to Section 3.8 with respect to a Product, the U.S. is excluded from the Royalty Bearing Territory with respect to such Co-Promoted Product during the applicable Co-Promotion Term.

Royalty Bearing Territory means (a) with respect to Co-Developed Products, all countries within the Biotest Territory and (b) with respect to Biotest Products, all countries within the Territory.

Examples of Royalty Bearing Territory in a sentence

• Astellas’s registration, maintenance and defense of any trademarks for Product in the Royalty Bearing Territory shall be at Astellas’s own cost and expense.

• In any Calendar Year where aggregate Net Sales of all Products in the Royalty Bearing Territory exceed […***…], an additional payment of […***…] shall be paid to Ambit by Astellas (in addition to the royalty payments payable pursuant to Section 4.3.1).
