Second Settlement Payment definition

Second Settlement Payment means any payment made by or on behalf of the Borrower to F-K of an agreed upon percentage as required in accordance with Paragraphs 15 or 16 of the Settlement Agreement.
Second Settlement Payment means that Thirty Million Four Hundred Thousand Dollar ($30,400,000.00) portion of the Total Settlement Payment to be paid by Defendant to the Qualified Settlement Fund in the manner set forth in Section 10.1.

Examples of Second Settlement Payment in a sentence

  • No later than five (5) business days after the entry of the Preliminary Approval Order, Class Counsel shall: (a) establish at a Financial Institution through the Settlement Administrator, an account (the “Escrow Account”) for the purpose of holding the Total Settlement Payment; and (b) provide notice to Defendant of the information needed to deposit the First Settlement Payment and Second Settlement Payment into the Escrow Account.

  • The Case Contribution Award(s) shall be payable from the Qualified Settlement Fund following the deposit of the Second Settlement Payment into the Escrow Account and shall be in addition to any portion of the Net Settlement Fund the Named Plaintiffs would otherwise be entitled to receive as Settlement Class members.

Second Settlement Payment means the Total Settlement Payment, less the First Settlement Payment, to be paid by Defendant to the Qualified Settlement Fund in the manner set forth in Section 10.1. The Second Settlement Payment shall be Twenty-Six Million Nine Hundred Thousand Dollars ($26,900,000.00) less the aggregate amount of (i) settlement payments made by any of the DST Defendants to any member of the Settlement Class in connection with the Arbitrations up to but not to exceed the amount of the Net Settlement Fund to which such member of the Settlement Class would be entitled under the Plan of Allocation had he or she not received a separate settlement payment; and (ii) any monetary judgment issued to any member of the Settlement Class and not reversed as of the Effective Date of the Settlement in connection with the Arbitrations against any of the Defendants associated with Plaintiffs’ Released Claims up to but not to exceed the amount of the Net Settlement Fund to which such member of the Settlement Class would be entitled under the Plan of Allocation had he or she not received a separate recovery.
Second Settlement Payment means the payment by the Borrower to the HMI Escrow Agent of $1,350,000 in cash in all respects pursuant to and in accordance with the Restated Stipulation of Partial Settlement.

  • Settlement Payment means the transfer, or contractual undertaking (including by automated clearing house transaction) to effect a transfer, of cash or other property to effect a Settlement.

  • Net Settlement Amount means the Gross Settlement Amount, less the following payments in the amounts approved by the Court: Individual PAGA Payments, the LWDA PAGA Payment, Class Representative Service Payment, Class Counsel Fees Payment, Class Counsel Litigation Expenses Payment, and the Administration Expenses Payment. The remainder is to be paid to Participating Class Members as Individual Class Payments.

  • Gross Settlement Amount means the sum of thirty-nine million eight- hundred thousand dollars ($39,800,000), contributed to the Qualified Settlement Fund in accordance with Article 5. The Gross Settlement Amount shall be the full and sole monetary payment, whether to the Class, Plaintiffs, Class Counsel, or otherwise, made by or on behalf of Reliance Trust Company in connection with the Settlement effectuated through this Settlement Agreement.

  • Structured settlement agreement means the agreement, judgment, stipulation, or release embodying the terms of a structured settlement.
