The Town and Developer shall enter into a Water and Sewer Service Agreement setting forth their agreement concerning water rights dedication, preliminary projections of water and sewer demand and a commitment by the Town for water and sewer service to the Development.
The Water and Sewer Service Agreement, whenever executed, shall be incorporated into this Agreement and made a part hereof.
These further acts shall specifically include, but are not limited to, signing successive Water and/or Sewer Service Agreement and Restrictive Covenant documents or agreements, signing successive Annexation Petitions, in the event prior annexation efforts are unsuccessful.
