Examples of Special Individual Assessment in a sentence
Once imposed, a fine or penalty may be collected as a Special Individual Assessment.
Upon the establishment of a Special Individual Assessment, the Board shall send written notice of the amount and due date of such Special Individual Assessment to the affected Owner(s) at least thirty (30) days prior to the date such Special Individual Assessment is due.
Any fine or penalty levied pursuant to this Section shall be considered a Special Individual Assessment as defined in Section 5.4, below.
Provided, however, Declarant shall not be obligated to pay any Special Individual Assessment except with Declarant’s prior written approval.
In addition, in the event that the Cooperative incurs any legal fees and/or costs incurred as a result of any act or omission of a member or the member’s invitee, the Cooperative shall be entitled to recover such fees and/or costs from the member as a Special Individual Assessment under Article IX of these Bylaws.
With the exception of Non-Member Owners who shall not be obligated to pay Regular or Special Assessments, each Owner shall pay when due each Regular, Special and Special Individual Assessment levied against the Owner and his or her Lot and shall observe, comply with and abide by any and all Association Rules set forth in, or promulgated by the Board pursuant to, any Governing Document for the purpose of protecting the interests of all Owners or protecting the Common Area and Common Facilities.
If any payment of a Regular or Special Assessment (installment or lump sum) or any payment of a Special Individual Assessment assessed to any Owner is not actually received by the Association or its designated agent within fifteen (15) days after the same becomes due, such payment shall be delinquent and the amount thereof may, at the Board's election, bear interest at the maximum rate allowed by law beginning thirty (30) days after the due date until the same is paid.
In the event any act or omission of any member, any member of the member’s Household, or any of the member’s Tenants, Guests or agents shall in any way cause or be responsible for any increase in the premiums for any insurance purchased or obtained by the Cooperative, the amount of such increase may, in the discretion of the Board, be assessed and charged solely to and against such member as a Special Individual Assessment but without right to impose a lien against the Share.
In the event of a default in the payment of any Special Individual Assessment, the Association may declare that Owner's Special Individual Assessment to be in default and pursue the remedies set forth in Section 5.9, below as to such delinquency, subject to Subsection (c) below.
As more particularly provided in Section 9.10 of this Declaration, the Association shall levy a Special Individual Assessment for the amount of the loss in insurance proceeds against any Owner who, in violation of this Declaration or other Governing Documents, caused any diminution in the insurance proceeds otherwise payable to the Association due to the Owner's individual casualty insurance.
