In such event, the Medical Staff Member may reapply for Medical Staff Membership and/or Clinical Privileges as a new Applicant.
In the event the Medical Staff Member remains suspended pursuant to this Section for a period greater than sixty (60) Days, and unless the Board determines that there is good cause to make an exception, the Medical Staff Member shall be deemed to have voluntarily withdrawn his or her Medical Staff Membership and/or Clinical Privileges, without right of appeal or Fair Hearing.
The Medical Staff Member shall have no right to a Fair Hearing, and no Notice is required, as a prerequisite to the suspension of the Medical Staff Member's Medical Staff Membership and/or Clinical Privileges.
THIS UNDERTAKING SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK APPLICABLE TO AGREEMENTS MADE AND TO BE WHOLLY PERFORMED WITHIN SUCH STATE.
The Fair Hearing and appeal process shall be the same for Applicants for Medical Staff Membership and/or Clinical Privileges and existing Medical Staff Members.
If the Board determines to deny initial Medical Staff appointment, reappointment, and/or Clinical Privileges to an Applicant, or to revoke or terminate the Medical Staff Membership and/or Clinical Privileges of a current Medical Staff Member, that Applicant or Medical Staff Member may not apply for Medical Staff Membership and/or Clinical Privileges at the Hospital for a period of five (5) years unless the Board provides otherwise.
If the MEC fails to take action, the Summary Suspension or Restriction will automatically expire in fourteen (14) Days with return of all previous Medical Staff Membership and/or Clinical Privileges.
The Board shall have the ultimate responsibility for the quality of medical care provided to patients and the ultimate authority to approve the granting of Medical Staff Membership and/or Clinical Privileges, and to approve the adoption of Medical Staff Bylaws and Rules and Regulations.
No person shall be automatically entitled to Medical Staff Membership or to the exercise of Clinical Privileges merely because he/she is licensed to practice, is a member of any professional organization, is certified by any board, or previously (but not currently) held Medical Staff Membership and/or Clinical Privileges at a System Hospital or at any other health care facility.
Neither voluntary relinquishment of Medical Staff Membership and/or Clinical Privileges, as provided in these Bylaws, nor the imposition of any general consultation requirement, nor the imposition of a requirement for retraining, additional training or continuing education, shall constitute grounds for a Fair Hearing, but shall take effect without hearing or appeal.
