State CapThe total of a Settling Distributor’s share of the amounts payable under the Global Settlement (a) to a State other than New York for a Payment Year assuming that State is eligible for Incentive Payments A and D and that no offset or suspension is applicable with respect to that State, and (b) for attorney’s fees and costs that would have been owed during that Payment Year times that State’s allocable share as specified in the Global Settlement.
