Stipulation of Dismissal definition

Stipulation of Dismissal or “Dismissal” refers to the stipulation of dismissal substantially in the form of Exhibit H, or such other motion, order or other form, necessary to dismiss with prejudice each Plaintiff’s Claims in the Litigation, regardless of whether the Plaintiff is the sole Plaintiff in a case or combined with other Plaintiffs.
Stipulation of Dismissal means a writing documenting a Luxe Claimant’s dismissal with prejudice of any state court litigation commenced by such Luxe Claimant against Luxe Energy and all other defendants in such litigation, on account of any obligation discharged or released under this Plan.
