Street Trading Consent definition

Street Trading Consent. – means a Consent granted under the Act and valid for not more than three years. Please Note: The use of a street as a smoking area outside premises is not considered to be Street Trading. The Council will not therefore usually consider requests for Consent where the use is solely for these purposes.
Street Trading Consent means a consent to trade in a street granted to any person by the Council pursuant to Schedule 4 to the 1982 Act; and

  • Any contravention of conditions may lead to revocation or non-renewal of the Street Trading Consent and/or prosecution.

  • Applicants who are granted Consent will be advised and once exact trading dates and appropriate fees are agreed, a Street Trading Consent will be issued.

  • Reviews The Council may review a Street Trading Consent if there are concerns or complaints after a Street Trading Consent has been granted.

  • In addition, an individual trader working under the benefit of a consent holder’s Street Trading Consent may be individually liable under the appropriate legislation.

  • Failure to comply with this requirement will be regarded as a breach of the conditions under which the Street Trading Consent is granted and may result in appropriate compliance action being taken.

  • A Street Trading Consent or Market Consent can be transferred from one person to another on approval from the Licensing Section but only on the provision that the location of the street trading remains the same.

  • The refusal of a Street Trading Consent on the grounds that there are already enough traders in the street, trading from other shops, or that there are other traders selling similar products, is not compatible with the EUSD and should no longer be used as a ground for refusal.

  • Applicants should be aware that applications may be refused, without the requirement for a Hearing, if the granting of a Street Trading Consent would constitute an offence under the Highways Act.

  • An application to review a Street Trading Consent or Market Consent must be made to the Licensing Section in writing and be supported by relevant information and/or documentation.

  • Consent Holders are therefore requested to familiarise themselves with the terms and conditions attached to the Street Trading Consent and comply with the requirements.
