Successfully Operating Transponder means a transponder which is operational and fully meets and satisfies the technical specifications as per Exhibit – A hereto. “Transponder Failure” means, with respect to any Transponder, such Transponder fails to provide Capacity (or part thereof) that meets the technical specifications as per Exhibit A in any material respect for any period of three (3) consecutive days. For purposes of this definition, measurement of periods of failure shall commence when the signal has been vacated to permit verification of the existence of the failure by DOS/Singtel. ARTICLE 2.
