Supply Deficiency definition

Supply Deficiency has the meaning set forth in Section 4.3.
Supply Deficiency means a failure by XXXX to produce the number of Batches at least equal to the number specified in the delivery schedule in the Project Plan.
Supply Deficiency. The Sellers shall provide the discount to the Buyer by way of credit note on the Quarterly Sellers Supply Deficiency in that Quarter (“Quarterly Price Adjustment”). The Quarterly Price Adjustment shall be Buyer’s sole remedy for Sellers’ failure to make available Sales Gas available for delivery under this Agreement.

More Definitions of Supply Deficiency

Supply Deficiency means the difference between the Product transferred under purchase order(s) accepted by Novasep that meet the requirements under this Agreement and the number specified in such purchase order(s) in the event that Novasep has failed totransfer to Tetraphase the quantities specified in the relevant purchase order(s).
Supply Deficiency means emergency situations whereby the Company is temporarily unable to procure gas supplies commensurate with its system requirements.
