Examples of Suretyship Liability in a sentence
The amount of any Person's obligation in respect of any Suretyship Liability shall (subject to any limitation set forth therein) be deemed to be the principal amount of the debt, obligation or other liability supported thereby.
Investment means, relative to any Person, (a) any loan or advance made by such Person to any other Person (excluding any commission, travel or similar advances made to directors, officers and employees of the Borrowers or any of their Subsidiaries), (b) any Suretyship Liability of such Person, (c) any ownership or similar interest held by such Person in any other Person and (d) deposits and the like relating to prospective acquisitions of businesses.
Investment means, relative to any Person, any investment in another Person, whether by acquisition of any debt or equity security, by making any loan or advance or by becoming obligated with respect to a Suretyship Liability in respect of obligations of such other Person (other than travel and similar advances to employees in the ordinary course of business).
ATC Entity Guaranty Condition means, as to any ATC Entity, that such ATC Entity (i) has become a Wholly Owned Subsidiary of the Company or (ii) has directly or indirectly provided any Suretyship Liability in respect of any Debt of the Company or any Subsidiary (other than another ATC Entity).
