Terminated Space definition

Terminated Space. As defined in Section 1.11(a).
Terminated Space. Is defined in Article 4.2 hereof.
Terminated Space means 38.75% of the Hilton Space.

  • The foregoing exclusions will not apply to sales, use, transfer, recording and similar taxes unrelated to Tenant’s Property or any Alterations which Tenant elects to remove or surrender, or the termination of the Master Lease with respect to any Terminated Space which is not the result of Tenant’s election.

  • In any event all rights or obligations of Tenant or Landlord with respect to any actual or potential Terminated Space shall remain in full force and effect.

  • From the date hereof until the Reduction Date, upon reasonable prior verbal notice to Tenant, Landlord shall have access to the Terminated Space for purposes of trying to lease the Terminated Space.

  • Subject to Landlord delay of completion of construction of improvements to the First Space, if Tenant fails to timely surrender the Terminated Space to Landlord in accordance with the provisions of this Amendment, the provisions of Article 23 of the Lease shall apply to any such holding over by Tenant with respect to the Terminated Space and Tenant shall not be released from its obligations, covenants and agreements under the Lease relating to the Terminated Space during such holdover period.

  • Tenant’s right to exercise such partial termination right shall be subject to Landlord’s reasonable approval of the configuration of the Terminated Space and the Remaining Premises and the location of the demising wall.

  • Landlord agrees to provide Tenant with full access to and use of the Terminated Space (i.e., the existing north restrooms) until the Restroom Completion Date.

  • The rentable square footage of the Revised Premises Area shall be determined as of a Reduction Date by subtracting the rentable square footage of the Terminated Space from the rentable square footage of the Premises immediately prior to such reduction.

  • Upon termination of this Lease (as it pertains to the applicable portion of the Terminated Space which is the subject of any such Termination option) pursuant to this Section 2.3, the parties shall be relieved of all further obligations under this Lease (as it pertains to the applicable portion of the Terminated Space which is the subject of any such Termination option) except for those obligations under this Lease which expressly survive the expiration or sooner termination of this Lease.

  • As used herein, the “Appropriate Share” shall mean a fraction (expressed as a percentage), the numerator of which is the total number of rentable square feet of the Terminated Space and the denominator of which is 33,257.

  • Tenant represents and warrants to Landlord that there are no agreements, written or oral, between Tenant and any other person or entity with respect to the occupancy of all or any portion of the Terminated Space after the Reduction Date.


More Definitions of Terminated Space

Terminated Space means, at Tenant's election as specified in the applicable termination notice, either (i) the entire Premises or (ii) a portion of the Premises consisting of entire floors of the Building (or so much of any floor as shall then be part of the Premises); provided, that in the case of any such partial termination, (x) all floors included within the Terminated Space shall be contiguous and (y) the Terminated Space shall include either (I) all or any of the floors the Untenantability of which gave rise to such termination right or (II) either the highest or lowest floor then included in the Office Space and any other floor(s) contiguous to such highest or lowest floor so long as the total rentable area of the Terminated Space does not exceed the rentable area of the portion of the Premises the Untenantability of which gave rise to such termination right. If an Eviction occurs by reason of Force Majeure, then Tenant's sole remedies in respect of such Eviction shall be as set forth in Sections 10.02 and 10.03 and Tenant hereby waives all other rights or remedies at law or in equity (including, without limitation, any right to claim a constructive eviction), if and to the extent that Tenant may be entitled to such rights or remedies by reason of such Eviction.

Related to Terminated Space

  • Leased space means a self−service storage unit or a space located within a self−service storage facility that a lessee is enti- tled to use for the storage of personal property on a self−service basis pursuant to a rental agreement and that is not rented or pro- vided to the lessee in conjunction with property for residential use by the lessee.

  • Expansion Space means any space in the Building which, at any time during the Lease Term, is occupied by a Person other than Landlord under a written lease with Landlord, and the term “Tenant’s Expansion Space” means Expansion Space which Tenant has elected to lease as provided in this paragraph. Landlord agrees to notify Tenant promptly after Landlord learns that any Expansion Space is or will become available. Subject to the prior rights of other tenants to whom Landlord has granted substantially similar rights, Tenant has the option to lease any Expansion Space which Landlord notifies Tenant is or will become available. If Tenant gives Landlord notice of its exercise of this option within thirty (30) days after notification from Landlord of the availability of the Expansion Space and if no Event of Default exists when Tenant’s notice is given, this Lease will be deemed to be amended to include Tenant’s Expansion Space as part of the Premises for the remainder of the Lease Term upon all of the same terms contained in this Lease except that (i) the Rentable Area of the Premises will be amended to include Tenant’s Expansion Space; (ii) Tenant’s Share will be increased to include the rentable area of Tenant’s Expansion Space; (iii) the Term Commencement Date with respect to Tenant’s Expansion Space will be the earlier of sixty (60) days after the date on which Tenant’s Expansion Space becomes vacant and ready for occupancy (provided that date is at least sixty (60) days after Tenant exercises its option to lease the Expansion Space), or the date on which the Expansion Space is first occupied by Tenant; (iv) if Tenant’s Expansion Space contains a rentable area of 10,000 square feet or more, and if there are less than three (3) Lease Years remaining in the Lease Term, the Lease Term will be extended to include three (3) full years from the Term Commencement Date with respect to Tenant’s Expansion Space; and (v) subject to adjustment during each Fixed Rental Period as provided in Exhibit E, Basic Rent for each year of the remaining Lease Term (as it may be extended) will be the greater of (a) the Basic Rent last paid by the Person most recently occupying Tenant’s Expansion Space or (b) Market Rent determined as provided in the Rent Rider attached as Exhibit E. If Tenant exercises this option, Tenant’s Expansion Space will be leased to Tenant in its “as is” condition and Tenant will, at its expense and in compliance with the provisions of Section 7.06, design and construct all Improvements desired by Tenant for its use and occupancy. Landlord and Tenant agree to execute such amendments to this Lease and other instruments as either of them considers necessary or desirable to reflect Tenant’s exercise of this option.

  • Work space means that portion of the court’s facilities dedicated to each court reporter, including but not limited to actual space in the courtroom and any designated office space.

  • Protected Space Operations means all Launch or Transfer Vehicle activities, ISS activities, and Payload activities on Earth, in outer space, or in transit between Earth and outer space in implementation of the IGA, MOUs concluded pursuant to the IGA, implementing agreements, and contracts to perform work in support of NASA’s obligations under these Agreements. It includes, but is not limited to:

  • Licensed Space means the indoor and outdoor space on the premises approved by the department for the purpose of providing licensed child care.

  • Storage Space means a space where goods of non-hazardous nature are stored and includes cold storage and banking safe vaults;

  • Commencement Date means the date of this Agreement;

  • Lease Term means the term of this Lease which shall commence on the Commencement Date and continue for the period specified in Section J of the Summary.

  • Subleased Premises means all that portion of the Leased Premises referred to as airport lot as outlined on the site diagram attached as Schedule "A" to this Sublease; and

  • Customer Premises means premises owned, controlled or occupied by the Customer which are made available for use by the Supplier or its Sub-Contractors for the provision of the Goods and/or Services (or any of them);

  • Commercial Premises Means a place of trade or premises operated for financial gain, including but not limited to, a retirement village or a block of flats that has a common facility; a place of trade where the manufacture and production of products or produce takes place; a site where renovation, restoration and refurbishment work as described in Appendix B takes place.

  • residential premises means a house, building, structure, shelter, or mobile home, or portion thereof, used as a dwelling, home, residence, or living place by 1 or more human beings. “Residential premises” includes an apartment unit, a boardinghouse, a rooming house, a mobile home, a mobile home space, and a single or multiple family dwelling, but does not include a hotel, a motel, motor home, or other tourist accommodation, when used as a temporary accommodation for guests or tourists, or premises used as the principal place of residence of the owner and rented occasionally during temporary absences including vacation or sabbatical leave.

  • School premises means either of the following:

  • Usable space means all the space on a pole, except the portion below ground level, the 20 feet of safety clearance space above ground level, and the safety clearance space between communications and power circuits. There is a rebuttable presumption that six feet of a pole are buried below ground level.

  • Occupancy Date means the date on which occupancy of all Units in a Project is permitted;

  • Lease Termination Date means the last day of the Lease Term.

  • Customer Premises Equipment or "CPE" means equipment employed on the premises of a Person other than a Carrier to originate, route or terminate Telecommunications (e.g., a telephone, PBX, modem pool, etc.).

  • Employment Commencement Date means the date on which the Employee first performs an Hour of Service.

  • Lease Commencement Date means the Closing Date. The “Lease Expiration Date” shall mean the later of (i) the date of the final payment in full of the French Advances and (ii) the Vehicle Lease Expiration Date for the last Lease Vehicle leased by the Lessee hereunder. The “Term” of this Agreement shall mean the period commencing on the Lease Commencement Date and ending on the Lease Expiration Date.

  • Premises means the location where the Services are to be supplied, as set out in the Specification.

  • Habitable space means space in a building used for living, sleeping, eating, or cooking. Habitable space does not include a heater or utility room, a crawl space, a basement, an attic, a garage, an open porch, a balcony, a terrace, a court, a deck, a bathroom, a toilet room, a closet, a hallway, a storage space, and other similar spaces not used for living, sleeping, eating, or cooking.

  • the Lease means the lease of the said land to be granted by the Lessor to the Lessee pursuant to clause 2.1;
