Examples of Trade Service in a sentence
All representations and warranties in these Terms are deemed to be made on each day (a) an Application is made and is being processed, (b) any Trade Service is outstanding and (c) any Customer Liabilities remain outstanding.
The Customer may not assign or transfer any of its rights or obligations under these Terms or a Trade Service.
If a process agent is specified in an Application or Facility Agreement in respect of a Trade Service, service of any legal process on the person whose name and address is specified in such Application or Facility Agreement shall constitute service on the Customer.
Any fee, interest or commission accruing in respect of a Trade Service will accrue from day to day and is calculated on the basis of the actual number of days elapsed and a year of 365 days or, in any case where the market practice in the relevant Governing Jurisdiction differs, in accordance with that market practice.
If the Customer is in doubt of any Trade Service, the Customer should seek independent professional advice.
If the Customer includes two or more persons, the obligations and liabilities of these persons under or in respect of a Trade Service and these Terms shall be joint and several.
Before applying for, or accepting, any Trade Service, the Customer shall make such enquiries and assessments as the Customer considers appropriate and the Customer should place no reliance on HSBC to give advice or make recommendations.
Any waiver, release or consent by HSBC under or in respect of these Terms or a Trade Service will only be effective if made in writing (which may be made through a Platform).
All amounts paid or payable to HSBC in respect of any Trade Service are expressed on a Tax-exclusive basis.
The Customer acknowledges that HSBC will rely on any representations and warranties made by the Customer including when HSBC assesses whether or not to provide a Trade Service to the Customer.
