Competing Service definition

Competing Service means implementation, consulting, support, maintenance, development and/or training services relating to or in connection with the use of any Company Products or Competing Products.
Competing Service means any: (i) public/private partnership that provides an electronic gateway to government services or procurement information; (ii) service that is substantially the same as, incorporates, is a material component or part of, or is based upon or competes with a service that has been provided, performed or offered by or on behalf the Company (or of any predecessor of the Company) at any time on or prior to the date of this Agreement or until the date of termination of employment; (iii) service that facilitates, supports or otherwise relates to the any Competing Product.
Competing Service means any satellite digital audio radio service offered in the continental United States within the frequency range from 2310 to 2360 megahertz.

Examples of Competing Service in a sentence

  • Provided that, once the Service Provider is able to provide the Service in compliance with this Agreement, or any Specific Service Agreement, as the case may be, the Service Purchaser shall, subject to ongoing compliance with this Agreement and any Specific Service Agreement, thereafter obtain such Service from the Service Provider, rather than a Competing Service.

  • Furthermore, in the case of any Commencement of Competing Service subsequent to a Qualifying Retirement, the Participant shall forfeit Restricted Stock Units (and associated Notional Dividends) as provided in Section 2(c).

More Definitions of Competing Service

Competing Service means any: (i) service that has been provided, performed or offered by or on behalf of the Company or any of its Affiliates at any time on or prior to the Effective Date; (ii) service that facilitates, supports or otherwise relates to the design, development, sale, distribution, marketing or licensing of any Competing Product; or (iii) service that is substantially the same as, is based upon or competes in any material respect with any service referred to in clause "(i)" or clause "(ii)" of this sentence.
Competing Service means (i) the design, engineering, fabrication, sale, rental, transportation, operation, repair and maintenance of, or provision of services utilizing, natural gas compressor packages used in the petroleum industry, and (ii) the design, engineering and sale of, or the provision of services utilizing, engine-driven crude oil pump packages used in the petroleum industry.
Competing Service means any service, process, solution or product that has been or is being developed, designed, produced, manufactured, marketed, promoted, sold, offered, licensed or serviced by any legal person other than Company that is the same or similar to, performs any of the same or similar functions, may be substituted for, or is intended to be or is used for any of the same purposes of any Employee-Related Service.

Competing Service means any service of any person or legal entity other than BMP, or a parent, subsidiary or affiliate of BMP, in existence or under development, which during the term of this Agreement, competes with or is an alternative to any present or planned future service of BMP, whether or not actively marketed by BMP.
Competing Service means any: (i) service that has been provided, performed or offered by or on behalf of any of the Acquired Companies (or any predecessor of any of the Acquired Companies) at any time on or prior to the date of this Noncompetition Agreement; (ii) service that is provided, performed or offered by the Purchaser, any of the Acquired Companies or any of the Purchaser's other subsidiaries at any time during the Noncompetition Period; (iii) service that facilitates, supports or otherwise relates to the design, development, manufacture, assembly, promotion, sale, supply, distribution, resale, installation, support, maintenance, repair, refurbishment, licensing, sublicensing, financing, leasing or subleasing of any Competing Product; or (iv) service that is substantially the same as, is based upon or competes in any material respect with any service referred to in clause "(i)", clause "(ii)" or clause "(iii)" of this sentence.
Competing Service means any telecommunications product or service, that is the same as or substantially similar to either a Teleglobe Service or Bell Service, or is otherwise competitive with either a Teleglobe Service or Bell Service, in circumstances where and to the extent that any such Teleglobe Service or Bell Service is subject to any exclusivity requirements, Right to Match, Flex, or a minimum volume commitment, as contemplated in the Master Agreement as amended pursuant hereto;
