Unknown Survivor Claim definition

Unknown Survivor Claim means Pre-Effective Date Unknown Survivor Claim and Post-Effective Date Unknown Survivor Claim.
Unknown Survivor Claim means any Survivor Claim alleging Abuse prior to the Effective Date, but neither filed nor deemed filed in the Chapter 11 Case, nor otherwise allowed by the Court by the Effective Date, and is held by an individual who was at the time of the Filing Date under a disability or other condition recognized by Pennsylvania law, or other applicable law suspending the running of the statute of limitation period, that would toll the statute of limitations on such Survivor Claim.
Unknown Survivor Claim means: any Survivor Claim against any of the Protected Parties alleging Abuse that occurred prior to the Effective Date, which was neither filed, nor deemed filed, by the Effective Date, and is held by an individual who: (i) was at the time of the Filing Date under a disability, for whom the applicable statute of limitations has not run, or other condition recognized by Pennsylvania law as tolling the statute of limitations on a Claim of the nature of a Survivor Claim (or other applicable law suspending the running of the limitation period, if any); or (ii) experienced Abuse prior to and including the Filing Date and whose Claim is timely under 42 Pa.C.S. § 5533(b)(2)(i)-(i.1 ).

  • Any holder of a General Unsecured Claim, Survivor Claim, or Unknown Survivor Claim will realize a loss in an amount equal to the Claim, minus any recovery, on an adjusted tax basis.

  • In addition, the Reorganized Debtor may object to any Unknown Survivor Claim and reserves all of its rights and defenses with respect to such Unknown Survivor Claims.

  • Unknown Claims means any Released Plaintiffs’ Claims which any Lead Plaintiff or any other Settlement Class Member does not know or suspect to exist in his, her or its favor at the time of the release of such claims, and any Released Defendants’ Claims which any Defendant or any other Defendants’ Releasee does not know or suspect to exist in his, her, or its favor at the time of the release of such claims, which, if known by him, her or it, might have affected his, her or its decision(s) with respect to this Settlement. With respect to any and all Released Claims, the Parties stipulate and agree that, upon the Effective Date of the Settlement, Lead Plaintiffs and Defendants shall expressly waive, and each of the other Settlement Class Members and each of the other Defendants’ Releasees shall be deemed to have waived, and by operation of the Judgment or the Alternate Judgment, if applicable, shall have expressly waived, any and all provisions, rights, and benefits conferred by any law of any state or territory of the United States, or principle of common law or foreign law, which is similar, comparable, or equivalent to California Civil Code §1542, which provides:

  • AWR Claim means any complaint or claim to a tribunal or court made by or on behalf of the Agency Worker against the Hirer and/or the Employment Business for any breach of the AWR;

  • IPR Claim means any claim of infringement or alleged infringement (including the defence of such infringement or alleged infringement) of any IPR, used to provide the Services or as otherwise provided and/or licensed by the Supplier (or to which the Supplier has provided access) to the Authority in the fulfilment of its obligations under this Framework Agreement;

  • Contingent Annuitant is the natural person who becomes the Annuitant if the Annuitant dies prior to the Income Date.

  • Proof of Claim and Release means the Proof of Claim and Release form for submitting a Claim, which, subject to approval of the Court, shall be substantially in the form attached hereto as Exhibit A-2, that a Class Member must complete and submit should that Class Member seek to share in a distribution of the Net Settlement Fund.

  • Prior Claims means the Competing Claims to which the Authority’s right to the Building Aid is subordinated by the School Financing Act.
