Warranty Defect definition

Warranty Defect means a defect in the Work resulting from faulty design, material or workmanship for which Seller is responsible.
Warranty Defect means a failure of the Performance Warranty Element to meet the Performance Threshold as set forth in the Warranty Performance and Measurement Table.
Warranty Defect has the meaning set forth in Section 9.3.

Examples of Warranty Defect in a sentence

  • Where a failure of the Work to satisfy the requirements of the General Warranty is also classified as a Warranty Defect under the Performance Warranty, the failure shall be remedied in accordance with the requirements applicable to the General Warranty described in this Section 3.8.1.2, unless TxDOT instructs that the remedy shall be implemented under the terms of the Performance Warranty.


More Definitions of Warranty Defect

Warranty Defect has the meaning assigned to such term in Section 7.5, below.
Warranty Defect means a failure of the Performance Warranty Element to meet the Performance Threshold as set forth in the Warranty Performance and Measurement Table. Warranty Inspection means any of the inspections identified in Section 32.10 of Item 32 of the Design- Build Specifications including Warranty annual inspection, Warranty investigative inspection, Warranty verification inspection, specialist inspections and Warranty final inspection.
Warranty Defect means a defect of a Goods which becomes apparent within the Warranty period, unless liability for such defect is excluded in compliance with these Conditions.
Warranty Defect shall have the meaning given to it in Section 17.2.1.

Related to Warranty Defect

  • Latent Defect means a defect, inherently lying within the material or arising out of design deficiency, which do not manifest themselves and/or was not reasonably discoverable during Defect Liability period.

  • Latent Defects means such defects caused by faulty designs, material or work-man- ship which cannot be detected during inspection, testing etc, based on the technology available for carrying out such tests.

  • Construction defect means a deficiency in or a deficiency arising out of the design, specifications, surveying, planning, supervision, or observation of construction or construction of residential improvements that results from any of the following:

  • Warranty means a warranty made solely by the manufacturer,

  • Defect Notice shall have the meaning specified in Section 3.2 of this Agreement.
