CONFIDENTIAL INFORMATION. All non-public, confidential or proprietary information of Vestas, including but not limited to, specifications, samples, patterns, designs, plans, drawings, documents, data, business operations, customer lists, pricing, discounts or rebates, disclosed by Vestas to Seller whether disclosed orally or disclosed or accessed in written, electronic or other form or media, and whether or not marked, designated or otherwise identified as “confidential” in connection with this Agreement is confidential, solely for the purpose of performing this Agreement and may not be disclosed or copied by Seller unless authorized in advance by Vestas in writing. Upon Xxxxxx’x request, Seller shall promptly return all documents and other materials received from Vestas. Vestas shall be entitled to injunctive relief for any violation of this Section. This Section does not apply to information that is: (a) in the public domain; or (b) known to Seller at the time of disclosure. This Seller´s confidentiality undertaking shall last for a period of five (5) years after termination hereof.
CONFIDENTIAL INFORMATION. The Supplier shall treat our orders and all related commercial and technical details as Confidential Information and use them only to perform its obligations towards us.

CONFIDENTIAL INFORMATION. The Customer acknowledges that in its relationship with Xxxxxxx and/or by virtue of the performance of the Agreement, it and/or its employees, shareholders, officers, directors, principals, agents and contractors (collectively, “Representatives”) will be and shall hereafter continue to be entrusted with Confidential Information, the disclosure of any of which to competitors of Cepheid or to the general public would be highly detrimental to the best interests of Cepheid. The Customer further acknowledges that the right to maintain confidential such Confidential Information constitutes a proprietary right of Cepheid, which Cepheid is entitled to protect. Accordingly, and notwithstanding anything to the contrary herein expressed, the Customer covenants and agrees with Cepheid:
CONFIDENTIAL INFORMATION. 14.1 “Information” means any business, financial, technical, operating or descriptive information drawings and concepts or know-how disclosed to Supplier in performance of this contract. Supplier agrees to maintain the Information in confidence and not to disclose it to any third party or use such Information for any other purpose, except as (i) authorized by us for the performance of this contract (ii) the Information is open to the public or has become public without default of the Supplier. Supplier shall not publicize the existence or scope of this contract without our written consent, and Supplier shall require these same agreements on the part of any supplier to whom the Information is disclosed. Upon written request, Supplier shall return all Information and copies thereof to us. 14.2 Supplier shall safeguard that his employees and subcontractors comply with these obligations. The confidentiality obligation shall apply even after completion of the contractual obligations.
CONFIDENTIAL INFORMATION. The term: (a) "products" as used only in this Section 9 means all products manufactured or sold by or for Edusa or services performed for Edusa, including the Goods and Services; and (b) "Edusa Confidential Information" means information or tangible materials, whether or not designated by Edusa as confidential, pertaining to: (i) product development, design, formulations, composition, research and development, or specifications; (ii) product manufacturing techniques, rates or quantities; (iii) equipment used to make products; (iv) any other aspects of Xxxxx'x business relating to products and services, including without limitation marketing, sales, customers and non-public financial data; (v) all Orders placed by Xxxxx; and (vi) the Parties' relationship.   • INFORMACIÓN CONFIDENCIAL Se entiende por Información Confidencial, la obtenida directa o indirectamente por la otra parte, ya sea en forma verbal, escrita o transmitida por cualquier medio electrónico o telemático, previa o con posterioridad a la firma de este instrumento y relativa a la prestación de los productos y de las operaciones previstas en el mismo, no considerada dentro del concepto xx xxxxxxx bancario. I. Información que sea del dominio público; II. Información que se encuentre actualmente o en el futuro llegase a estar a disposición de las partes libre de restricción, provenga de una fuente distinta; siempre y cuando las partes no tengan conocimiento de que dicha fuente se encuentra sujeta a alguna disposición de confidencialidad o; III. Información respecto a la cual las partes puedan probar fehacientemente por medio de documentos, que era de su conocimiento libre de restricciones antes de su revelación. La obligación de confidencialidad estará vigente a partir de la firma de este instrumento y durante un plazo de dos años contados a partir de su terminación. Asimismo, las partes se obligan a devolver o destruir la Información Confidencial entregada o comunicada con motivo del presente instrumento, dentro de los quince días hábiles siguientes a la recepción de la notificación que por escrito le haya sido enviada para estos efectos. Si alguna de las partes es requerida por cualquier autoridad para divulgar o revelar en todo o en parte la Información Confidencial, hará su mejor esfuerzo para notificar el requerimiento a la otra parte antes de dar cumplimiento al mismo y, en caso de que no fuera factible tal notificación, deberá comunicar a su contra parte a la brevedad posible la situación mencionada y los actos realizados para dar cumplimiento a la misma. En caso de que cualquiera de las partes o cualquiera de los empleados, asesores, funcionarios incumplan con la obligación de confidencialidad, independientemente de la naturaleza o gravedad del incumplimiento, la parte que haya incumplido estará obligada a pagar a la otra parte la cantidad que, como daños y perjuicios fuere determinada por los tribunales competentes.
