Définition de Specifications

Specifications means any document defining the requirements with which the Supplier must comply, the needs of the IRT and the conditions for the performance of the Order.
Specifications our product specifications, especially those on our technical data sheets, are only given as an indication; they can be modified without prior notice, either for reasons beyond our control, or to take account of subsequent improvements. Returns: no product return will be accepted without our prior agreement. We reserve the right to send back, at the customer’s expense, any product returned to us without our prior agreement. If accepted for return, a capital loss for product control and restocking costs may be applied. In the event of judicial settlement or liquidation of buyer’s assets, and in accordance with the provisions of the law 80-335, dated May 12th 1980, demand for these goods may be made within 4 months of the publication of the judgment initiating proceedings, in application of the law.
Specifications means the technical specifications, requirements, production methods, documentation, packing and marking instructions, additional directives, designs, relevant standards, software, models, tools, plans, instructions, additional data or drawings of the entire range of the Supplier’s Supplies mentioned in the Contract and/or Order. 2.6 “Subcontractor(s)” means any and all firms carrying out on behalf and under the responsibility of the Supplier all or part of the Supplier’s obligations under the Contract. 2.7 “Supply” means the goods, equipment, accessories, tools (including but not limited to any and all raw materials or components of the foregoing), designs, documentation, services, software, plans, equipment and/or consultancy services purchased by WFR and designed, manufactured, tested, stored and/or delivered by the Supplier pursuant to the Contract and to the Order(s). 2.8 “Technical Data” means any and all data relating to the technical operational parameters of any Supply delivered, including but not limited to any and all information collected by sensors, instruments, monitors or other industrial control devices or SCADA, located at the site of Wärtsilä’s end customer or on the Supply.

  • This conformity check consists, in particular, in checking, without prejudice to any clarifications and additions that may appear in the Specifications: - the qualitative and/or quantitative compliance of the Deliverables with the functional, safety and quality specifications or the technical proposal approved by the IRT; - the conformity of the Deliverables with the user manual; - the provision of the information necessary for the implementation of the Deliverables.

  • It shall carry out the additional tests and inspections listed in the Specifications, the Order and/or required by WFR by any and all other means.

  • It counts on the Supplier’s quality management system, which must inspect the production process and guarantee that the Supply complies with the Specifications and this Contract.

  • All orders placed with BDM - PS imply the full acceptance by buyer of the applicable BDM - PS General Quality Specifications in effect at the time of order.

  • Modifications include, but are not limited to increases or reduction in quantity, changes to Specifications and execution of the Supply in whol or in part, as well as changes to the Delivery schedule.

  • Subject to the limitations contained in the paragraph entitled “Warranty and Limitation of Liability” below, all Products will, at the time of delivery (within the meaning of the applicable Incoterms), meet the specifications set forth in the BDM - PS Drawings and BDM - PS General Quality Specifications applicable thereto at the time of order as well as any other specifications applicable thereto explicitly agreed to in writing by BDM - PS and buyer (collectively, the “Product Specifications”).

  • Notwithstanding application of the warranty provided for in Article 10.3, WFR is entitled to scrap the Supply and cancel the Order if the Supply is defective and/or non-compliant with the Specifications, the usual criteria and/or the codes of practice.

  • Any price request from a Customer must include a set of Technical Specifications (TS) or refer to a known international standard.

  • BD represents and warrants that at the time of delivery (within the meaning of the applicable Incoterms) the Products meet the Product Specifications.

  • The Deliverables must comply in all respects with the Specifications, the Supplier's technical proposal approved by the IRT and the specific conditions as referenced and/or defined in the Order.
