Employer entitled to recover compensation paid to workmen. If, for any reason, the Employer is obliged, by virtue of the provision the Workmen's Compensation Act 1923, or any statutory modifications or re-enactment thereof, to pay compensation to any workmen, employed by the contractor in execution of the works, under the scope of the contract, the Employer shall be entitled to recover, from the contractor, the amount of compensation so paid, and without prejudice to the rights of the Employer under the said Act. The Employer shall be at liberty to recover such amount or any part thereof, by deducting it, from the Security D eposit or from any payment, due by the Employer to the contractor, under this contract or otherwise. The Employer, shall not be, bound to contest any claim, made against it, under the said Act, except on the written request of the contractor and upon her / his / their, giving to the Employer full security to the satisfaction of the Employer, for all costs, for which the Employer, might become liable, in consequence of contesting such claim. 10.
