This article seeks to verify that the contract cannot be limited to two individualist parties with opposing interests and responsibilities. The contract must include the joining of wills in favor of the common, following the concepts of Fraternity Law and the social function of the contract. In order to materialize the Fraternity Law in the field of social relations, it is necessary to keep in mind that the individual must put himself in the other's place, so that it is possible to see how another "I" with innate human duties and rights. The deductive method was used through bibliographic collection in parallel with the legal diplomas. It was concluded that its application can result in a more harmonious and prosperous society.
