NO WAIVER. 9.1 The Client acknowledges that no act, omission to act or forbearance by The Broker or any of its employees, servants or agents shall be, or be deemed to be, a waiver by The Broker of any rights against the Client or against Collateral, or any assets of the Client on hand with The Broker.

NO WAIVER. 21.1 Unless otherwise provided by applicable laws, no act or omission by Bank pursuant to these Terms and Conditions shall affect Bank’s rights, powers or remedies.

NO WAIVER. No waiver by either Party with respect of any breach or default or of any right or remedy and no course of dealing, shall be valid unless expressly agreed upon between the Parties in writing in accordance with Clause 17 (“Written Form”). No such waiver shall be interpreted as continuous waiver or waiver for any other occurrence.
