NOTICE. PLEASE BE ADVISED THAT TRADING IN BULLION INVOLVES THE POTENTIAL FOR PROFIT AS WELL AS THE RISK OF LOSS WHICH MAY UNDER ADVERSE TRADING CONDITIONS EXCEED THE AMOUNT OF INITIAL MARGIN DEPOSIT. MOVEMENTS IN THE PRICE OF BULLION ARE INFLUENCED BY A VARIETY OF FACTORS OF GLOBAL ORIGIN AND DIMENSION, MANY OF WHICH ARE UNPREDICTABLE. VOLATILE MOVEMENTS IN THE PRICE OF BULLION MAY RESULT IN ACTION BY THE MARKET OR THE RELEVANT REGULATORY BODY AS A RESULT OF WHICH A CLIENT MAY BE UNABLE TO SETTLE ADVERSE TRADES. ALTHOUGH THE STAFF AND REPRESENTATIVES OF EMPEROR ARE IN CONSTANT TOUCH WITH MARKET MOVEMENTS, THEY MIGHT UNABLE TO GUARANTEE THE ACCURACY OF THEIR PREDICTIONS NOR COULD THEY GUARANTEE ANY LOSS SHALL NOT EXCEED A SPECIFIED FIGURE.
NOTICE. If you wish to notify us in writing about anything relating to this agreement, you should write to OCEAN DIGI PTY LTD PO BOX 3094 Asquith NSW 2077 We will notify you by sending a notice in the ordinary post to the address you have given us in the Any notice will be deemed to have been received on the third banking day after posting.
NOTICE. Without prejudice to other methods of communication, any Monthly Statement, notice, demand for payment or any other communication shall be deemed to have been received by the Cardholder:
(a) if it has been posted in the business outlets of the Bank for three (3) Business Days; or
(b) three (3) Business Days after it has been published on a Macau newspaper; or
(c) when it is posted on the website of the Bank; or
(d) three (3) Business Days after it has been sent by post to any of the Cardholder's addresses on the Bank's records (or seven (7) days in case of an overseas address); or
(e) when it is sent by e-mail, message or facsimile to the Cardholder's e-mail address, equipment or facsimile number on the Bank's records; or
(f) when it is communicated through the recording system of a telephone or by other forms of oral communication (including leaving a voice message), notwithstanding that the mail has been returned (if sent by post) or the Cardholder has died or become incapacitated.
NOTICE. 9.1 All communications sent to the contact details registered by the Customer with the Bank or via the Service to Customer’s designated mobile phone shall be deemed to be delivered to the Customer at the time when the communication was sent by the Bank. If in the Bank’s opinion the communications sent further to the details registered with the Bank or to Customer’s designated mobile phone have failed to reach the Customer, we may in our sole discretion stop sending further communications.
9.2 Any notice from the Bank to the Customer may be made in such manner and by such means of communication as the Bank shall deem fit, including, without limitation, use of direct mailing material, advertisement, branch display, publicity on our official website(xxx.xxxxxxxx.xxx.xx), electronic communications such as e-mail or via the Service etc..
NOTICE. 21.1 A notice or demand by us under the Agreement may be served by post, personal delivery, cable, telex, electronic mail or facsimile transmission and shall be deemed to have been duly served if by post on the day following the day of posting (its subsequent return or non-delivery notwithstanding) and if by personal delivery, cable, telex, electronic mail or facsimile transmission at the time on the day of such personal delivery, cable, telex, electronic mail or facsimile transmission if addressed to you or the legal or personal representative(s) of you at the last known address according to our record.
21.2 A notice by you or your legal representative(s) or your estate may be served by post, personal delivery, cable, telex or facsimile transmission at the registered office or last known address of us but shall not be deemed to have been duly served unless and until actual receipt of such post, personal delivery, cable, telex or facsimile transmission by us.
NOTICE. 19.1 Any notice given by the Cardholder hereunder shall be given in writing and delivered to the Company at its address at Avenida Praia Grande No.517, Edificio Commercial Nam Tung 11B, Macau.
19.2 Without affecting other methods of communication, any statement, notice, demand or other communications are deemed to be received by the Cardholder:
(a) on posting for 3 Business Days in the Macau Office of Company.
(b) 3 Business Days after publication as an advertisement in a Macau newspaper,
(c) when posted on the website of the Company,
(d) when left at any of the address of the Cardholder on the Company°’s record, or 48 hours after mailing to such address or 7 days if the address is overseas,
(e) when sent by electronic mail or message or facsimile to any of email address or equipment or facsimile number of the Cardholder on the Company’s record, or
(f) when communicated including by leaving a voice message, if by telephone or other oral communication, notwithstanding return through the post (in the case of a mailing), or the death or incapacity of the Cardholder. “Business Day” means a day on which the Banks are open for business in Macau other than Sunday and public holiday.
NOTICE. 21.1 Every notice, communication or request under these Terms and Conditions (other than those notices, communications or requests given by us pursuant to the provisions of these Terms and Conditions which may be oral) must be in writing and may, without prejudice to any other form of delivery, be delivered personally or sent by post or transmitted by fax or electronic mail.
21.2 In the case of posting, the envelope containing the notices, communications or requests must be addressed to the intended recipient at the last known address of that party and must be properly stamped or have the proper postage prepaid for delivery by the most expeditious service available and, in the case of a fax or electronic mail, the transmission must be sent to the intended recipient at the authorized or designated number or electronic mail address of that party.
21.3 No change in any of your particulars will be effective unless and until we have actually received notice of change in respect thereof.
21.4 Any notice, communication or request will be deemed to have been duly given and received:-
(i) in case of personal delivery, upon delivery;
(ii) in the case of posting, on the second day (or seventh day if overseas) after the day of posting;
(iii) in the case of a fax, on the date and at the time of the completion of the transmission to the specified facsimile machine provided that the transmitting facsimile machine has received and printed out a report confirming receipt or if the day of transmission is not a Business Day, on the next Business Day; and
(iv) in the case of an electronic mail, on the date and at the time of the completion of the transmission to the designated electronic mail box or if the day of transmission is not a Business Day, on the next Business Day.
NOTICE. 15.1 Unless otherwise provided hereunder, all notices or communications (collectively referred to as "Notice") required or permitted under the Conditions of Purchase shall be made in writing and sent by private carrier (e.g., Fed Ex, UPS) or by facsimile or other electronic means to the appropriate address of each party as stated below. If delivered by private carrier (e.g., overnight delivery, next-business-day delivery, etc.), a notice shall be deemed to be duly served on the date of the private carrier's scheduled delivery; if sent by facsimile or other electronic means during regular business hours on a business day, it shall be deemed served on that business day, or on the next business day if sent during non-business hours of a business day. 15.2 Either party shall promptly notify the other party of any change of its address set forth above by a written notice.
NOTICE a) All notices or approvals required or permitted under this Agreement must be given in writing to QONECO or to you at the addresses specified above or as otherwise agreed in writing by the Parties from time to time.
b) We use the internet (website and email) as the primary means of communication. In addition, we have the right but not the obligation, to also make use of other means of communication at our discretion.
c) For communication by email, you must arrange for a well-functioning and secure email account with a reliable provider, to which only you have access. As part of taking reasonable security measures you must ensure to not log into your email account on or through any publicly accessible computer (such as an internet café) or a publicly available network. Furthermore, you must ensure and guarantee that your email account will accept messages sent by us. As email communication is not secure and not encrypted, you should access your account on the Online Services website to view sensitive information.
d) You should check your email account regularly and for new messages from us. It is recommended that you should check your email account at least every day. You must always respond to the messages sent by us within the period specified in the messages. If you do not respond or do not respond within a suitable time, then any resulting losses shall be completely for your own account and risk.
NOTICE. Sale of any Products or Services is expressly conditioned on Buyer's assent to these Terms and Conditions. Any acceptance of Seller’s offer is expressly limited to acceptance of these Terms and Conditions and Seller expressly objects to any additional or different terms proposed by Xxxxx. No facility entry form shall modify these Terms and Conditions even if signed by Xxxxxx’x representative. Any order to perform work and Xxxxxx'x performance of work shall constitute Xxxxx’x assent to these Terms and Conditions. Unless otherwise specified in the quotation, Seller’s quotation shall expire 30 days from its date and may be modified or withdrawn by Seller before receipt of Buyer’s conforming acceptance.
