2Term of Agreement. Subject to the provisions of Article 2.3, this Agreement shall remain in effect for a period of twenty-five (25) years from the Effective Date and shall be automatically renewed for each successive one-year period thereafter.
2Term of Agreement. Subject to the provisions of Article 2.3, this Agreement shall remain in effect until the later of the dates on which: (i) all of the EPC Services have been completed, or (ii) the final payment of all invoices has been made.
2Term of Agreement. This Agreement shall become effective as of the Effective Date and shall continue until the Parties have satisfied their respective obligations as set forth in this Agreement, unless sooner terminated in accordance with the provisions set forth herein.
2Term of Agreement. Unless earlier terminated pursuant to the terms of this Agreement, the “Term” of this Agreement shall be from the Effective Date until December 31 following the conclusion of the last annual review process pursuant to Section 4.2(c). In the event that a Suspension Period applicable to all Transactions under this Agreement has occurred and is continuing for more than seven hundred thirty (730) consecutive days, then either Party may terminate this Agreement, and if payments have been made to Seller, then with respect to each Designated System, Seller shall return the amount of payment based on the applicable Contract Price and on the difference between the number of RECs used to calculate payment and the number of RECs Delivered from such Designated System. 22 Subject to Section 7.1(g), Seller’s Performance Assurance will be returned to Seller by Buyer upon payment by Seller of such amount.
