Above and Beyond Discharger’s Obligations. This study and the associated technical report go above and beyond the discharger’s applicable obligations required under the permit issued by the Regional Water Board 1202551.1 or what can be accomplished with the discharger’s required monetary contributions to the Regional Monitoring Program for Water Quality in San Francisco Bay (RMP).
Above and Beyond Discharger’s Obligations. This SEP provides no direct benefit to West County Agency, which has no obligation to provide financial or other support for this project, will receive no direct or indirect benefit from this effort, and will not direct or exercise any control over the SEP.
Above and Beyond Discharger’s Obligations. The City voluntarily agrees to undertake the SEP, and the City is not required to undertake this project.

Above and Beyond Discharger’s Obligations. Peninsula CSD voluntarily agrees to undertake the SEP, and is not required to undertake this project. This project was never considered by Peninsula CSD before or absent the current regulatory enforcement action.
Above and Beyond Discharger’s Obligations. The City of Modesto has no obligation to provide emergency shelter for the unsheltered community on City-owned property. The City voluntarily agrees to undertake the SEP in settlement of an enforcement action to offset civil penalties. The SEP is not commenced until after the stipulated order is in effect (SEP Policy, section III.3.)
Above and Beyond Discharger’s Obligations. The City of Xxxxxxx has no obligation to replace lateral connection lines on private property. Lateral connections to the City’s wastewater collection system are the responsibility of the property owner. The grant program will provide funds for residents of the City to connect to the City’s system.
Above and Beyond Discharger’s Obligations. The Discharger provides for the collection, treatment, and discharge of sanitary sewerage. Surface water treatment is not under its realm of responsibilities. Therefore, the proposed SEP would be above and beyond the Discharger’s obligations. The Discharger is a Subsidiary District of the City of Daly City and a separate legal entity.

This SEP provides no direct benefit to the Xxxxxxxx Refining Company LLC (MRC), which has no obligation to provide financial or other support for this project, will receive no direct or indirect benefit from this effort, and will not direct or exercise any control over the SEP.
Above and Beyond Discharger’s Obligations. While the City is generally obligated to maintain its collection system, this project is not a mandatory for compliance any applicable requirement at this time.
