This SEP provides no direct benefit to Xxxxxxxx Refining Company LLC, which has no obligation to provide financial or other support for this project, will receive no direct or indirect benefit from this effort, and will not directly or indirectly exercise any control over the SEP. This SEP is above and beyond what is required in permits or orders issued by the Regional Water Board or what can be accomplished with required monetary contributions to the Regional Monitoring Program for Water Quality in San Francisco Bay.

Above and Beyond Discharger’s Obligations. The City of Modesto has no obligation to provide emergency shelter for the unsheltered community on City-owned property. The City voluntarily agrees to undertake the SEP in settlement of an enforcement action to offset civil penalties. The SEP is not commenced until after the stipulated order is in effect (SEP Policy, section III.3.)
Above and Beyond Discharger’s Obligations. The Discharger provides for the collection, treatment, and discharge of sanitary sewerage. Surface water treatment is not under its realm of responsibilities. Therefore, the proposed SEP would be above and beyond the Discharger’s obligations. The Discharger is a Subsidiary District of the City of Daly City and a separate legal entity.
Above and Beyond Discharger’s Obligations. This SEP contains only measures that go above and beyond DLA’s obligations. The project is not part of DLA’s normal business nor is DLA otherwise required to implement any portion of the project.
Above and Beyond Discharger’s Obligations. The City of Xxxxxxx has no obligation to replace lateral connection lines on private property. Lateral connections to the City’s wastewater collection system are the responsibility of the property owner. The grant program will provide funds for residents of the City to connect to the City’s system.
