Absence of Defects and Quality. Valantic will provide the Service free from material and title defects and maintain the Software in a quality suitable for contractual use during the term. The contractually agreed quality of the Software is governed solely by the contractual Service Description, not by information on the website, oral or written statements of valantic prior to the formation of the Agreement, or information contained in the marketing materials of valantic. The obligation to maintain the Software does not include the adjustment of the Software to changed conditions of use and technical and functional developments such as change of the IT environment, in particular change of hardware or operating systems, adjustment to the scope of functionality of competing products or creation of compatibility with new file formats.

  • STANDARDS AND QUALITY The Supplier shall at all times during the Contract Period ensure that the Services are delivered in accordance with: the Digital Service Design Manual (and the Supplier shall comply with the processes and procedures set out therein); the Standards; the KPIs; the Methodology; the applicable SOW; and all other applicable provisions of this Contract.
