Acceptance of GMP Proposal. If Owner accepts the GMP Proposal, as may be amended by Design-Builder, the GMP and its basis shall be set forth in an amendment to this Agreement.
Acceptance of GMP Proposal. Upon written acceptance by the Owner of each Task GMP Proposal, the GMP and its basis shall be set forth in a TA.
Acceptance of GMP Proposal. 8.5.4.1 If the District accepts the GMP Proposal, an Amendment or Change Order will be issued to the DBE, which shall be the basis for Work for construction.
8.5.4.2 The Accepted GMP Proposal shall extend the Scope of Work and be incorporated into the Agreement, Appendix C.
Acceptance of GMP Proposal. At such time as the Owner and the Construction Manager agree on an acceptable Guaranteed Maximum Price for the cost of the Project, the Owner and the Construction Manager shall, in good faith, enter into an amendment of this Agreement, as to such Project, pursuant to which specific terms, conditions and provisions shall be set forth regarding:
(i) a scope of work for the Project, together with a reasonably detailed description of plans and specifications for such Project,
(ii) a Project Progress Schedule for the Project, and,
(iii) provisions for damages in the event the Construction Manager defaults with respect to its obligations regarding construction of the improvements for such Project.
Acceptance of GMP Proposal. If Owner accepts the GMP Proposal, as may be amended by Design-Builder, its basis shall be set forth in Agreement Between Owner and Design–Builder, Cost Plus Fee with an Option for a Guaranteed Maximum Price.
Acceptance of GMP Proposal. If Owner accepts the GMP Proposal, as may be amended by Design-Builder, the GMP and its basis shall be set forth in an amendment to this Agreement.
5.8.2.3.1 Owner may suggest modifications to the GMP Proposal, whereupon, if such modifications are accepted in writing by Design-Builder, the GMP Proposal shall be deemed accepted and the Parties shall proceed in accordance with Section 5.8.2.2; or
5.8.2.3.2 Owner may terminate this Agreement for convenience in accordance with Article 16; provided, however, in this event, Design-Builder shall not be entitled to the payment provided for in Article 16.
Acceptance of GMP Proposal. If the District accepts the GMP Proposal, as may be amended by Design-Builder, the GMP and its basis shall be set forth in an amendment to this Agreement. Such amendment shall contain any terms and conditions required by the State of Ohio, Department of Administrative Services. A condition precedent to any approval of the GMP Amendment shall be the approval by the District’s Board of Trustees.
Acceptance of GMP Proposal. Upon acceptance by the Owner of the GMP Proposal, as MAY be amended by the Design-Builder in accordance with Subparagraph 3.2.3, THE GMP AND ITS BASIS shall be set forth in Amendment No. 1. The GMP and the date of Substantial Completion and/or the date of Final Completion shall be subject to modification in Article 9.
Acceptance of GMP Proposal. Upon acceptance by the Owner of the GMP Proposal, the GMP and its basis shall be set forth in Amendment 1.
Acceptance of GMP Proposal. If Owner accepts the GMP Proposal, as may be amended by Design-Builder, the GMP and its basis shall be set forth in an amendment to this Agreement. Failure to Accept the GMP Proposal. If Owner rejects the GMP Proposal or fails to notify Design-Builder in writing on or before the date specified in the GMP Proposal that it accepts the GMP Proposal, the GMP Proposal shall be deemed withdrawn and of no effect. In such event, Owner and Design-Builder shall meet and confer as to how the Project will proceed, with Owner having the following options: Owner may suggest modifications to the GMP Proposal, whereupon, if such modifications are accepted in writing by Design-Builder, the GMP Proposal shall be deemed accepted and the parties shall proceed in accordance with Section 6.6.2.
