GMP Proposal means the proposal submitted by CM@Risk that sets forth its Guaranteed Maximum Price and all assumptions and/or clarifications concerning the Contract Documents and Project upon which the GMP is based.
GMP Proposal means a proposal for completing the Project, which proposal shall include the proposed Guaranteed Maximum Price for the construction of the Project, as provided by the Construction Manager and accepted by the City based upon the Drawings and Specifications; the Contract Documents; and the Memorandum of Changes. The City has no obligation to accept the GMP Proposal regardless of the amount or its relationship to estimates provided.
GMP Proposal as used herein means a proposal for completing a Project in the form attached as Exhibit “C” attached hereto, which Proposal shall include the proposed guaranteed maximum price for the construction of such Project based upon the Drawings, Specifications, and other Contract Documents.

If Owner determines that there is merit in considering the GMP Proposal, it shall so notify Contractor, whereupon the Parties shall negotiate in good faith and attempt to reach agreement on the terms of the proposal.
The GMP Proposal (including the GMP itself) represents Contractor’s offer to construct the Project in accordance with the Drawings and Specifications, at no increase in the GMP, with the understanding that the Contractor Contingency accounts for clarifications, assumptions, and further development of the GMP Proposal Design Documents into the Drawings and Specifications.
If the Parties reach agreement on the GMP Proposal, as such proposal may be amended by Contractor to reflect discussions between the Parties, the GMP Proposal shall be incorporated into a GMP Amendment to the Agreement.
It is intended that the Baseline Schedule developed by Contractor as part of the GMP Proposal will be derived from the most current Project Schedule.
If Owner authorizes Contractor to prepare a commercial proposal for an Early Work Package, the Parties will work together in good faith to develop the specific process for doing so, with the understanding that the process is intended to generally follow the submittal and negotiation process set forth for the GMP Proposal.

GMP Proposal means that proposal developed by Design- Builder in accordance with Section 2.3 of CAP Form DB544 Progressive Design-Build Agreement or Section 6.6 of CAP FormDB530 Standard Form of Agreement Between Owner and Design-Builder – Cost Plus Fee With an option for a Guaranteed Maximum Price.

GMP Proposal means XXXX Firm’s proposal to perform the Construction Phase Work, which is prepared and submitted to City for approval in accordance with Section I.E.16 of the Scope of Work (Preconstruction Phase) and the considerations in Section 9.4, as such proposal may be amended in accordance with this Agreement.

Notice To Proceed means a written letter or directive issued by the Director or City’s Project Manager acknowledging that all conditions precedent have been met and directing that the Construction Manager may begin Work on the Project or a specific task of the Project. Parking Agreement shall have the meaning ascribed to it in the Recitals. Pre-Construction Fee means the fixed lump sum fee of Pre-Construction Phase Services mean the services the Construction Manager shall perform for the design phase of the Agreement and culminates with the exercise by City of one of the City’s options regarding the GMP proposal. Pre-Construction Work means all Work required by this Agreement during the Pre- Construction Phase of the Project including the IGMP submittals. Professional Services means those services within the scope of the practice of architecture, professional engineering, landscape architecture, or registered surveying and mapping, as applicable, as defined by the laws of the State of Florida, or those performed by any architect, professional engineer, landscape architect, or registered surveyor or mapper in connection with his or her professional employment or practice.
