Access To And Use Of The BNYM System. The terms of Schedule C to this Agreement shall apply to the Fund’s access to and use of any component of the BNYM System (as defined in Schedule C).
Access To And Use Of The BNYM System. The terms of Appendix B to this Agreement shall apply to the Fund's access to and use of any component of the BNYM System (as defined in Appendix B). BNYM shall provide the Fund with access to and use of those components of the BNYM System for which the Fund pays a fee in accordance with the Fee Agreement or with respect to which the Fee Agreement indicates the fee is included in the Account Fees (as such term is used in the Fee Agreement).
7. Section 3 is deleted and replaced in its entirety with the following;
Access To And Use Of The BNYM System. The terms of Schedule B to this Agreement shall apply to the Fund’s access to and use of any component of the BNYM System (as defined in Schedule B). Commencing on the Service Effective Date, BNYM shall provide the Fund with access to and use of those components of the BNYM System for which the Fund pays a fee in accordance with the Fee Agreement or with respect to which the Fee Agreement indicates the fee is included in the Account Fees (as such term is used in the Fee Agreement).
Access To And Use Of The BNYM System. The terms of Appendix C to this Agreement shall apply to the Fund’s access to and use of any component of the BNYM System (as defined in Appendix C).
Access To And Use Of The BNYM System. In the event the Fund is given the right to access or use any part of the BNYM System (as defined in Section 9), the terms of Schedule D shall apply.
Access To And Use Of The BNYM System. The terms of Schedule D to this Agreement shall apply to the Company’s access to and use of any component of the BNYM System (as defined in Schedule D). BNYM acknowledges and agrees that to the extent the Company’s or an Investment Company’s use of the BNYM System pursuant to Schedule D is contingent upon or enhanced by BNYM’s performance of the services set forth at Section 3(a) of the Agreement, including the inputting of data, BNYM remains responsible for providing the data in accordance with its obligation under Section 3(a).
Access To And Use Of The BNYM System. The Funds shall have the rights to access and use the BNYM System (as defined in Schedule C) solely with respect to the FSR Accounts and solely pursuant to the terms and conditions of Schedule C. No rights to access and use or otherwise utilize the BNYM System in any manner with respect to the SuRPAS Accounts is granted by this Section 3(d) or by Schedule C.
Access To And Use Of The BNYM System. Mutually agreed upon electronic access terms and conditions as may be agreed upon from time to time by the Fund, the investment adviser or its and their affiliates and BNYM shall apply to the Fund’s access to and use of any component of the BNYM system. BNYM shall provide the Fund with access to and use of those components of the BNYM system for which the Fund pays a fee in accordance with the Fee Agreement or with respect to which the Fee Agreement indicates the fee is included in the Account Fees (as such term is used in the Fee Agreement).
Access To And Use Of The BNYM System. The terms of Exhibit C to this Agreement shall apply to the Fund’s access to and use of any component of the BNYM System (as defined in Exhibit C).
(i) A new Exhibit C is added which reads in its entirety as set forth in the Exhibit C attached to the Amendment To Transfer Agency Services Agreement, dated as of September 9, 2016, among BNYM and the Fund.
(j) A new Exhibit D is added which reads in its entirety as set forth in the Exhibit D attached to the Amendment To Transfer Agency Services Agreement, dated as of September 9, 2016, among BNYM and the Fund.
(k) The following are deleted from the Current Agreement:
(i) Amendment to the Transfer Agency Services Agreement, effective May 30, 2003, between the Investment Company and BNYM (providing for Proxy Advantage services).
(ii) Amendment To Transfer Agency Services agreement, made as of March 1, 2007, between the Investment Company and BNYM (providing for access to and use of the BNYM 22c-2 technology product).
Access To And Use Of The BNYM System. BNYM shall provide access and use to the BNYM System (as defined in Schedule D) and the terms of Schedule D shall apply thereto.
