ACCIDENT PREVENTION. (a) It is understood and agreed The Subcontractor agrees that the parties prevention of accidents to this Agreement shall at all times workmen engaged upon or in the vicinity of the Work is its responsibility. When so ordered, the Subcontractor shall stop any part of the Work which Contractor deems unsafe until corrective measures satisfactory to Contractor have been taken, and the Subcontractor agrees that it shall not make any refusal claim for damages growing out of such stoppages. Should the Subcontractor neglect to take such corrective measures, Contractor may do so at the cost and expense of the Subcontractor and may deduct the cost thereof from any payments due or to become due to the Subcontractor. Failure on the part of Contractor to stop unsafe practices shall in no way relieve the Subcontractor of its responsibility therefore The Subcontractor agrees to indemnify, protect, and save harmless Contractor from any and all claims, actions, fines and penalties brought or imposed or judgments rendered thereof, and from and against any and all loss, damages, liability, costs and expenses, including legal fees and disbursements, which Contractor and/or the Owner may sustain or incur as a result of an accident involving the Work. The Subcontractor shall notify Contractor of any injury to any one of its employees or any employee of one of its subcontractors, with respect to work in contravention the Work, on the day of the injury and provide a written description of the injury within three (3) days of the date of such regulations injury. Notwithstanding any other provision of this Subcontract, the Subcontractor acknowledges that it is ultimately responsible for all construction safety procedures and precautions under Federal, State, County and Municipal law which pertain to the Work, and the Subcontractor shall hold, indemnify and save the Owner and Contractor harmless from and against any and all claims or expenses resulting from any act taken by any employee of the Subcontractor, a sub-subcontractor, or any injury or damage caused by any unsafe or negligent act or occurrence resulting from the Work. See Schedule “C” for insurance and indemnity requirements. The Subcontractor covenants and agrees that it shall not be deemed sublet any part of the Work hereunder without requiring its subcontractors to purchase and maintain insurance policies and coverage required by the terms and conditions of Article 23. The Subcontractor shall furnish satisfactory evidence that its subcontractors have purchased said insurance by causing a certificate of insurance, including the XXXXX 855 if applicable, to be a breach of this Agreementfurnished to Contractor. Further, no employee will be discharged because they fail to work under unsafe conditions as set out in Compliance by the regulations. Any refusal of an employee to abide by known Workers’ Compensation Board regulations, after being duly warned, will be sufficient cause for dismissal.
(b) Any employee may refuse to work where, in their opinion, adequate safety precautions have not been provided. The operator of a vehicle or piece of equipment may refuse to drive or operate such vehicle or equipment if, in their opinion, there is any reasonable doubt Subcontractor with the foregoing requirements as to the safety carrying of insurance and furnishing of certificates of insurance shall not in any way relieve the Subcontractor from any liability or diminish its obligations under this Article or any other provision of the unitSubcontract. Within twenty-four (24) hours of all accidents or occurrences resulting in injury to the Subcontractor’s employees, or if third parties or damage to property of another, the operator feels it is improperly loadedSubcontractor shall submit a written report, in a form acceptable to Contractor. When requested by Contractor, the Subcontractor shall furnish Contractor with a copy of any reports prepared for submission to the Subcontractor’s insurance company. The operator may not Subcontractor agrees to be ordered bound to operate Contractor by the terms and conditions of Contractor’s agreements with the Owner, a copy of said vehicle agreement being available for inspection at the office of Contractor. ACCIDENT PREVENTION. Health and Safety Committee The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the Hospital in order to prevent accidents, injury and illness, Recognizing its responsibilities under the applicable legislation, the Hospital agrees to accept as a member of its Accident Prevention Health Safety Committee at least one (aI) It is understood representative selected or appointed by the Union from amongst bargaining unit employees. Such Committee shall identify potential dangers and agreed that hazards, institute means of improving health and safety programmes and recommend actions to be taken to improve conditions related to safety and health. The Hospital agrees to co-operate reasonably in providing necessary information to enable the parties Committee to this Agreement fulfil its functions. Meetings shall be held every second month or frequently at the call of the chair if required. The Committee shall maintain minutes of all times comply meetings and make the available for review. Any representative appointed or selected in accordance with hereof shall serve for a term of one calendar year from the date appointment which may be renewed for further periods of one (I) year. Time off for such to attend meetings of the Accident Prevention Health Safety Committee in accordance with the accident prevention regulations of the Workers' Compensation Act, foregoing shall be granted and any refusal on the part of an employee to work in contravention of time spent attending such regulations meetings shall not be deemed to be a breach work time for which the shall be paid by the Hospital at his regular OF premium rate as may be applicable. The Union agrees to endeavour to obtain the full co-operation of this Agreement. Further, no employee will be discharged because they fail to work under unsafe conditions as set out its membership in the regulationsobservation of all safety rules and practices. The operator of a vehicle or piece of equipment may refuse to drive or operate such vehicle or equipment if, in their opinion, there is any reasonable doubt as at no cost to the safety of the unit, or if the operator feels it is improperly loaded. The operator may not be ordered to operate said vehicle or equipment until they have been satisfied any defects have been corrected.

Employees engaged in a Return to Work program as part of the Employer’s Injury Management Program will be paid eight (8) hours of straight time to a maximum of forty (40) hours per week while participating in the program.
