ACCIDENT PREVENTION. ‌ a) In order to provide safety controls for protection to the life and health of employees and other persons; for prevention of damage to property, materials, supplies and equipment; and for avoidance of work interruptions in the performance of this contract, the contractor shall comply with all pertinent provisions of the latest version of U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, in effect on the date of the solicitation and will also take or cause to be taken such additional measures as the contracting officer may determine to be reasonably necessary for the purpose. b) The contractor will maintain an accurate record of and will immediately report to the contracting officer in the manner and on the forms prescribed by the contracting officer, exposure data and all accidents resulting in death, traumatic injury, occupational disease and/or damage to property, materials, supplies and equipment incident to work performed under this contract. c) The contracting officer will notify the contractor of any noncompliance with the foregoing provisions and the action to be taken. The contractor shall, after receipt of such notice, immediately take corrective action. Such notice, when delivered to the contractor or contractor’s representative at the site of the work, shall be deemed sufficient for the purpose. If the contractor fails or refuses to comply promptly, the contracting officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop order shall be made the subject of claim for extension of time or for excess costs or damages by the contractor. d) Compliance with the provisions of this clause by subcontractors will be the responsibility of the contractor. e) Prior to commencement of the work, the contractor will meet in conference with representatives of the contracting officer to discuss and develop mutual understandings relative to administration of the overall safety program.

The contractor shall within five days or within such time as determined by the contracting officer, after date of commencement of work, prepare and submit to the contracting officer for approval, a practicable schedule showing the order in which the contractor proposes to carry on the work, the date on which the contractor will start the several salient features (including purchasing of materials, plant and equipment) and the contemplated dates for completing the same. The contractor shall submit to the contracting officer at the end of each week a brief written report of the percentage of work accomplished for each work element during that week, or at such other intervals of time as may be established by the contracting officer. If the contractor fails to submit the required progress schedule(s) and progress reports, the contracting officer may withhold approval of progress payment estimates until such time as the contractor submits required schedules and reports. The contractor shall furnish sufficient work forces, construction plant, and equipment and shall work such hours, including night shifts, overtime operations, and Sunday and holiday work, as may be necessary to ensure the prosecution of the work in accordance with the approved progress schedule. If, in the opinion of the contracting officer, the contractor falls behind the progress schedule, the contractor shall take such steps as may be necessary to improve the contractor’s progress, and the contracting officer may require the contractor to increase the number of shifts, and/or overtime operations, days of work and/or the amount of construction plant, and to submit for approval any supplementary schedule or schedules in chart form as the Contracting Officer deems necessary to demonstrate how the approved rate of progress will be regained, all without additional costs to the Exchange. Failure of the contractor to comply with the requirements of the contracting officer under this provision shall be grounds for determination by the contracting officer that the contractor is not prosecuting the work with such diligence as will ensure completion within the time specified. Upon such determination, the contracting officer may terminate the contractor's rights to proceed under the clause of this contract entitled "Termination for Default--Damages for Delay--Time Extensions."
