Account Maintenance and Cardholder Responsibilities. 2.2.1 The Cardholder is responsible for all obligations arising out of the ownership and maintenance of the Account. This includes the amount of any check, draft, or other instrument (each, an "Item") deposited to the account and service charges to the Account. The losses arising from the breach of any obligation, representation or warranty made to the Bank or under applicable law, and the costs incurred to enforce the rights or to collect any sum the Cardholder owes the Bank, including reasonable attorney's fees, shall be borne by the Cardholder.
