ACTIONS BY EMPLOYEES. In any and all claims against any indemnified person by any employee of Contractor or any Subcontractor or by anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable, the indemnification obligation stated above shall not be limited in any way by any limitation on the amount or type of damages, compensation or benefits payable by or for Contractor or any Subcontractor under the applicable workers’ compensation benefit acts, disability statute or other employee benefit acts.
ACTIONS BY EMPLOYEES. (a) In any and all claims against any Owner Indemnified Person by any employee of either Contractor or any Subcontractor or anyone directly or indirectly employed by either Contractor or any Subcontractor or anyone for whose acts either Contractor or any Subcontractor may be liable, the indemnification obligation set forth in Section 11.2 shall not be limited in any way by any limitation on the amount or type of damages, compensation or benefits payable by or for Contractor or such Subcontractor under the applicable workers’ compensation benefits acts, disability statute, or other employee benefit acts.
(b) In any and all claims against any Contractor Indemnified Person by any employee of Owner or anyone directly or indirectly employed by either Owner or anyone for whose acts either Owner may be liable, the indemnification obligation set forth in Section 11.3 shall not be limited in any way by any limitation on the amount or type of damages, compensation or benefits payable by or for Owner under the applicable workers’ compensation benefits acts, disability statute, or other employee benefit acts.
