Acts of Others. Except as required under ERISA, the Plan Administrator has no responsibility or obligation under the Plan to Participants or Beneficiaries for any act required of the Employer, the Trustee, the Custodian or any other service provider to the Plan (unless the Plan Administrator also serves in such capacities).

Acts of Others. Landlord shall not be responsible or liable to Tenant, or to those claiming by, through or under Tenant, for any loss or damage which may be occasioned by or through the acts or omissions of third parties or persons occupying space adjoining the Leased Premises or any part of the Leased Premises or any other part of the Building or the Project. In addition, Landlord shall not be responsible or liable to Tenant for any loss or damage resulting to Tenant, or those claiming by, through or under Tenant, or any of its property, from fire; explosion; falling plaster; the breaking, bursting, stoppage or leaking of water, gas, sewer, electrical cables, wires or steam pipes; or from water, rain or other substances leaking or coming from the roof, street, subsurface or from any other place or from dampness or from any similar risks or causes. Landlord shall not be liable for any loss or damage to any person or property sustained by Tenant or any other persons, which may be caused by theft, or by any act or neglect of any tenant or occupant of the Building or the Project, or of any other third parties.
Acts of Others. The Agent shall not be responsible for any failure or inability of the parties to this Agreement, or of anyone else, to deliver the Collateral to the Agent or otherwise to honor any of the provisions of this Agreement. The Agent shall be fully protected in acting on and relying upon any written notice, direction, request, waiver, consent, receipt or other paper or document which the Agent in good faith believes to be genuine and to have been signed or presented by the proper party or parties from time to time.
Acts of Others. CSTC will not be liable or responsible for the acts, omissions or defaults of any agent or other person to whom duties may be properly delegated by CSTC under the Custody Agreement if such agent or person was appointed with due care. CSTC will not be liable or responsible for any act within the sole power of another, nor shall CSTC be liable or responsible for any act or omission by the Authorized Person.
Acts of Others. All persons entering the Auction premises acknowledge that an auction site is a potentially dangerous place, which includes the operation of equipment and access to certain lots and areas that may be inherently dangerous. Every person, which includes, but is not limited to the Buyer, as well as Buyer’s representatives, agents and associates, who enter the auction site, before, during and after the auction sale shall be deemed to be there at their own risk with notice of the condition of the premises, the activities on the premises and the conduct of any third parties and shall so advise their agents, employees and associates. No person shall have any claim against Auctioneer, Seller or Landlords, or any of their respective agents, employees or principals at any Sale Site, for any injuries sustained nor for damages to or loss to persons or property which may occur from any cause whatsoever. Auctioneer, Seller and Landlords, as well as their agents, employees or representatives, shall not be liable by reason of any defect in or about the condition of the premises on which the auction is held. Buyer specifically releases Auctioneer, Seller and Landlords, as well as their agents and representatives from all liability thereof.
Acts of Others. Except as set forth in Article XIII, Section 1(c), neither party (a “Non-Acting Party”) shall be liable for any act or omission of the other party (the “Acting Party”) or any other entity (other than any Affiliate of the Acting Party or any of their contractors, agents or personnel) furnishing equipment, software or services to the Acting Party, its Affiliates or end users, nor, except as set forth in Article XIII, Section 1(c), shall the Non-Acting Party be liable for any damages or losses to the extent due to the fault or negligence of Acting Party or its Affiliates or end users or to the failure of equipment, software, or services of the Acting Party, its Affiliates or end users.
Acts of Others. Members are responsible for any act or failure to act of members of their household and guests. This includes any person they or members of their household or guests invite or allow onto Co-operative property. Members must take reasonable steps to prevent any wrongful act or failure to act by such persons and may be evicted if they do not do so. If there is a financial loss as a result of any act or failure to act of the persons mentioned above, the members will have to bear the financial loss even if they had no opportunity to prevent the action.
