Addition of Products. Effective as of the Amendment Effective Date, Exhibit A-3 Price Lists to the Agreement is hereby amended to add the Products set forth in Schedule 1 hereto. The price of such Products and other pertinent information concerning such Products is also set forth in Schedule 1 hereto.
Addition of Products. Path will not produce or sell any Products, and will not use the Names in connection with any Products, until Rockford has approved such Products and added them to Exhibit A as approved Products. When a Product is approved and added to Exhibit A, Rockford and Path will also agree whether the Product is to be "exclusive" under the terms of this Agreement. Except as otherwise specifically agreed by Rockford and Path, all Products will be exclusive.
Addition of Products. Contractor may request to add products to its PA at any time during the term of the PA. The request must contain the name of the product, price per ton, and any other costs associated with the new product. If the product is not included in the latest version of ODOT’s “Asphalt Material Standard Specifications,” Contractor must submit the following product information for approval by ODOT’s pavement engineering section: Specifications Use Application rates Requests must be submitted to ODOT’s PA Administrator; email is preferred. If ODOT approves the product to be added to the PA, ODOT will process an amendment which will be effective upon signatures by Contractor and ODOT.
Addition of Products. The Proposer may request to add products to its Price Agreement at any time during the term of the Price Agreement. The request must contain the name of the product, price per on, and any other costs associated with the Specifications. Addition of Products. The Parties may add a Product to this Agreement from time to time by entering into an amendment to this Agreement (individually referred to as a "Product Amendment"). Each Product Amendment shall form a part of this Agreement and shall contain a description of the Product to be Formulated pursuant to the terms of that Product Amendment and of this Agreement, the Specifications for such Product, the Price payable by Purchaser to Supplier for the Product, territory(ies) in which Purchaser proposes to distribute same and any additional provisions relating to such Product as the Parties may agree to. For greater certainty, neither Party shall have an obligation to add a Product to the Agreement. Each Party shall have the sole discretion as to whether or not it agrees to add a Product to this Agreement.

When a Product is approved and added to Exhibit A, Rockford and ACI shall also agree whether the Product is to be "exclusive" pursuant to the terms of section 4.1 of this Agreement. Except as otherwise specifically agreed by Rockford and ACI, Installation Accessories shall be exclusive and all other Products, including Installation Tools, Promotional Materials, and Installation Software, shall be non-exclusive.
