Additional Reopeners. AFA and the District may each open four (4) additional articles during this three-year period. Additional articles may be opened by mutual agreement, but require a sunshine period. The Vice President of Academic Affairs will notify AFA of its intent to amend, repeal, or create a policy, procedure, or Board-approved plan in order to determine its relationship to scope of bargaining. In the case that AFA has a right to bargain, articles so opened will be opened by mutual agreement. All articles require a sunshine period before negotiations may commence.

  • Additional Facilities If the CAISO determines that it requires Operational Control over additional transmission lines and associated facilities not then constituting part of the CAISO Controlled Grid in order to fulfill its responsibilities in relation to the CAISO Controlled Grid then the CAISO shall apply to FERC pursuant to Section 203 of the Federal Power Act, and shall make all other regulatory filings necessary to obtain approval for such change of control and shall serve a copy of all such applications on the affected Participating TO and the owner of such lines and facilities (if other than the Participating TO). In the event that a Party invokes the dispute resolution provisions identified in Section 15 with respect to the transfer of Operational Control over a facility, such facility shall not be transferred while the dispute resolution process is pending except pursuant to Section 4.5.2.

  • Additional Works If the Employer requests the Contractor to provide additional works or services which are not either envisaged by, or ancillary to the Works to be provided under, this Contract then the Contractor shall comply with any such request as if such request were a Variation instruction and the provisions of this clause 13 [Variations and Adjustments] shall apply accordingly.

  • Wage Reopener The parties agree they may re-open negotiations on compensation adjustments dependent upon economic feasibility. Indicators of economic feasibility will be: the Director determines implementation of such adjustments is economically feasible and the legislature appropriates funding in accordance with applicable law; if a State initiative or referendum is submitted to the voters and is passed that specifically provides funding for general salary increases for higher education employees; or the University provides across the board salary increases to Civil Service and/or Administrative Professional employees. If tentative agreement is achieved, the University will submit a request to OFM for a finding of financial feasibility and, if such a finding is made, for approval and funding by the Governor and Legislature when necessary.
