Adjustment to Contract Price. If the Construction Change Directive provides for an adjustment to the Contract Price, the adjustment shall be based on one of the following methods:
Adjustment to Contract Price. The Parties acknowledge the Contractor’s bid amount is based on drilling a 550 foot well which hits a water reservoir sufficient for the Owner’s needs. The Contractor’s bid is calculated on a per foot basis. Therefore, the Parties shall adjust the Contract Price based on the amount of feet necessary for the Contractor to successfully hit the desired water reservoir based on the necessary depth. The Parties acknowledge the Contract Price may increase or decrease depending on the depth needed. Such adjustments to the Contract Price shall be performed pursuant to Article IX below.
