Adjustments to Charges. In addition to any other adjustments provided for in this Service Tariff, in any Billing Period, the Authority may make appropriate adjustments to xxxxxxxx and charges to address such matters as billing and payment errors, and the receipt of actual, additional, or corrected data concerning Customer energy or demand usage.

Egenera represents to Unisys that, to the best of its ability, this information, particularly as it relates to configurations, and call volumes, is, in all material respects, is substantially accurate, complete, and contains no material omissions. If such information provided by Egenera is materially and substantially inaccurate, incomplete or omitted you agree that Unisys may, request a change to such charges. If the parties are unable to agree on an adjustment to such charges within thirty day after such request, then Unisys may terminate this Agreement upon thirty days notice without liability to Egenera and Egenera shall pay for all work performed up to the effective date of such termination. Egenera may request reductions in future recurring maintenance charges for the additional systems in cities where there are four (4) or more Egenera Bladeframe systems being supported by Unisys under this Agreement.
Adjustments to Charges. Changes to Service Fees will be made if Customer’s monthly usage exceeds ten times (10x) the usage of XXXX.XXXXX’s average customer, as XXXX.XXXXX determines in its discretion. XXXX.XXXXX will notify Customer thirty (30) days before any Service Fee is effective. Customer understands and acknowledges that Xxxx Charges and Taxes are items charged by 3rd party providers and/or governmental/jurisdictional authorities, and XXXX.XXXXX does not have control over the amount of these charges. Accordingly, Xxxx Charges and Taxes are subject to change without notice.
