Common use of - AMENDMENT AND SUCCESSOR RIGHTS Clause in Contracts

- AMENDMENT AND SUCCESSOR RIGHTS. 1.01 Any article of this agreement that is deemed by both the employer and the Union to require amendment, alteration or deletion, may be amended, altered or deleted by mutual consent. Both parties must agree in writing to open negotiations for any such amendment, alteration or deletion naming the specific articles to be negotiated. Mutual agreement on any amendment, alteration, or deletion must be signed by both parties and recorded as an official amendment of this agreement. Should mutual agreement not be achieved then the existing article or articles shall remain in full force and effect. 1.02 Where the business of the employer is sold, leased, transferred, merged or otherwise disposed of, the purchaser, lessee or transferee shall be bound by all of the terms and conditions of this agreement. Likewise where the Union is merged or transferred, the new Union shall be bound by all the terms and conditions of this agreement.
