ANNUAL COST REPORT ADJUSTMENT AND SETTLEMENT. Based on the Annual Cost Report(s), at the end of each Fiscal Year or portion thereof that Agreement is in effect, the cost of all mental health services rendered hereunder shall be adjusted as follows: Cost Reimbursement – Settled to the lesser of actual and allowable costs or charges, not to exceed the applicable Maximum Contract Amount. Reimbursement for Xxxxx-Xxxxx/Medi-Cal funded services shall not exceed the State Maximum Allowance (SMA) in effect at the time of service delivery. County Audit Settlements – If, at any time during the term of this Agreement or at any time after the expiration or termination of this Agreement, authorized representatives of COUNTY conduct an audit of CONTRACTOR regarding the services provided hereunder and if such audits finds that COUNTY’s dollar liability for such services are less than payments made by COUNTY to CONTRACTOR, then the difference shall be due by CONTRACTOR to COUNTY. If such audit finds that COUNTY’s dollar liability for such services provided hereunder is more than payments made by COUNTY to CONTRACTOR, then the difference shall be paid to CONTRACTOR by COUNTY by cash payment, provided that in no event shall COUNTY’s Maximum Contract Amount for the applicable Fiscal Year be exceeded. Within ten (10) days after written notification by COUNTY to CONTRACTOR of any amount due by CONTRACTOR to COUNTY, CONTRACTOR shall notify COUNTY as to which of the following six (6) payment options CONTRACTOR requests to be used as the method by which such amount shall be recovered by COUNTY.
