Anti-Money Laundering/USA PATRIOT Act. The Company hereby certifies that it has established and maintains an anti-money laundering ("AML") program that includes written policies, procedures and internal controls reasonably designed to identify its Contract owners and has undertaken appropriate due diligence efforts to "know its customers" in accordance with all applicable anti-money laundering regulations in its jurisdiction including, but not limited to, the USA PATRIOT Act of 0000 (xxx "Xxxxxxx Xxx"). The Company further confirms that it will monitor for suspicious activity in accordance with the requirements of the Patriot Act and any other applicable regulations. The Company agrees to provide the Trust with such information as it may reasonably request, including but not limited to, the filling out of questionnaires, attestations and other documents, to enable the Trust to fulfill its obligations, if any, under the Patriot Act.

Anti-Money Laundering/USA PATRIOT Act. To assist grant making charities with compliance with Anti-Money Laundering statutes and the USA Patriot Act, the Treasury Department issued Anti- Terrorist Financing Guidelines: Voluntary Best Practices For U.S.-Based Charities (Voluntary Best Practices) in December of 2005. While Treasury’s guidelines are voluntary, Section VI of the Voluntary Best Practices contains recommended practices that charities may consider before making a charitable grant. Sponsor has developed its Grant making Due Diligence process based on these Voluntary Best Practices. Sponsor vets its own officers and directors against the OFAC SDN list when appointed. If Sponsor uncovers an organization or other party that is suspected of activity relating to terrorism, Sponsor will take appropriate due diligence steps to determine if the match is valid. These steps may include the steps and further guidance available on OFAC’s Web site at xxx.xxxxx.xxx/xxxxxxx/xxxxxxxxxxx/xxxx/xxx/xxxxxx.xxxxx#xxxxxxx. Sponsor will report to the proper authorities any suspicious activity relating to terrorism.

  • Bank Secrecy Act; Money Laundering; Patriot Act Neither the Company, nor to the Company’s knowledge, any Company Affiliate, has violated: (i) the Bank Secrecy Act, as amended, (ii) the Money Laundering Laws or (iii) the Uniting and Strengthening of America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism (USA PATRIOT ACT) Act of 2001, and/or the rules and regulations promulgated under any such law, or any successor law.
