Financing Guidelines definition

Financing Guidelines means Green Tree's written policies and -------------------- procedures, as such policies and procedures may be amended from time to time, (a) relating to the operation of its Floorplan Business and Asset-Based Lending Business, including the written policies and procedures for determining the interest rate, if any, charged to Dealers, the other terms and conditions relating to Green Tree's wholesale financing accounts, the creditworthiness of Dealers and the extension of credit to Dealers, and (b) relating to the maintenance of accounts and collection of receivables.
Financing Guidelines means DFS's written policies and procedures, as such policies and procedures may be amended from time to time, (a) relating to the operation of the Floorplan Business, the Accounts Receivable Business and the Asset Based Lending Business, including the written policies and procedures for determining the interest rate, if any, charged to Dealers, the other terms and conditions relating to DFS's wholesale financing accounts, the creditworthiness of Dealers and the extension of credit to Dealers, and (b) relating to the maintenance of accounts and collection of receivables.
Financing Guidelines means the financing guidelines for the Company established from time to time pursuant to Section 6.2.

Examples of Financing Guidelines in a sentence

  • Subject to Section 3.01, in the ordinary course of business, the Servicer may at any time delegate any duties hereunder to any Person who agrees to conduct such duties in accordance with the Floorplan Financing Guidelines and this Agreement.

  • Conversely, any advances to such Dealer made by the Seller under a Cash Management Agreement will be treated as a supplemental advance to such Dealer and, in accordance with the Floorplan Financing Guidelines, the aggregate principal amount of Receivables in the related Account will increase by the amount of such supplemental advance.

  • Prepayments made by a Dealer to the Seller under a Cash Management Agreement will be treated as Principal Collections and, in accordance with the Floorplan Financing Guidelines, the aggregate principal amount of Receivables in the related Account will decrease by the amount of such prepayment.

  • It will take no action, nor omit to take any action, that would impair the rights of the Noteholders, the holders of the Transferor Interest or any Series Enhancers in the Receivables nor will it reschedule, revise or defer payments due on any Receivable except in accordance with the applicable Floorplan Financing Guidelines.

  • With respect to any Account, prepayments made by a Dealer to the Seller under the related Cash Management Agreement will be treated as Principal Collections and, in accordance with the Floorplan Financing Guidelines, the aggregate amount of Principal Receivables financed in connection with such Account will decrease by the amount of such prepayment.

  • The Seller will comply with and perform its servicing obligations with respect to the Accounts and the Receivables in accordance with the applicable Floorplan Financing Agreements relating to the Accounts and the applicable Floorplan Financing Guidelines, except insofar as any failure to so comply or perform would not materially and adversely affect the rights of the Buyer, the Issuer, the Noteholders or any Series Enhancers.

  • Subject to compliance with all Applicable Law, the Seller, in its capacity as Servicer, may change the terms and provisions of any of the Floorplan Financing Agreements or the Floorplan Financing Guidelines in any respect (including the calculation of the amount or the timing of charge offs and the rate of interest charged on the Receivables) only if such change would be permitted pursuant to Section 3.1(d) of the Sale and Servicing Agreement.

  • With respect to any Account, deposits made by a Dealer into the related Cash Management Account will be treated as Principal Collections and, in accordance with the Floorplan Financing Guidelines, the aggregate amount of Principal Receivables financed in connection with such Account will decrease by the amount of such deposit.

Financing Guidelines means the written policies and procedures of BCI 'SS' 1.01 and its Affiliates, as such policies and procedures may be amended from time to time, (a) relating to the operation of BCI's floorplan financing business, including the written policies and procedures for determining the interest rate charged to Obligors, the other terms and conditions relating to BCI's wholesale financing accounts, the creditworthiness of Obligors and the extension of credit to Obligors, (b) relating to the extension of credit by certain Affiliates of BCI to their customers and distributors in connection with certain products manufactured or distributed by such Affiliates, and the purchase of such receivables by BCI, and (c) relating to the maintenance of accounts and collection of receivables.

Financing Guidelines means the written policies and procedures of an Originator, as such policies and procedures may be amended from time to time, (a) relating to the operation of a floorplan financing business, including the written policies and procedures for determining the interest rate charged to Dealers, the other terms and conditions relating to an Originator’s revolving financing accounts, the creditworthiness of Dealers and the extension of credit to Dealers, and (b) relating to the maintenance of accounts and collection of receivables.
Financing Guidelines means the guidelines and parameters governing the financing or refinancing of any Company Property. The initial Financing Guidelines approved by the Members are set forth on Exhibit B hereto.

Related to Financing Guidelines

  • Operating Guidelines means the guidelines for the creation and redemption of Units of a class as set out in the schedule to each Participation Agreement as amended from time to time by the Manager with the approval of the Trustee, and where applicable, with the approval of HKSCC and the Conversion Agent, and following consultation, to the extent reasonably practicable, with the relevant Participating Dealers subject always, in respect of the relevant Operating Guidelines for a Participating Dealer, any amendment being notified in writing by the Manager in advance to the relevant Participating Dealer. Unless otherwise specified, references to the Operating Guidelines shall be to the Operating Guidelines for the relevant Sub-Fund applicable at the time of the relevant Application.

  • Bidding Guidelines means the “Tariff Based Competitive-Bidding Guidelines for Transmission Service” and “Guidelines for Encouraging Competition in Development of Transmission Projects” issued by Government of India, Ministry of Power dated 13th April 2006 under Section – 63 of Electricity Act and as amended from time to time;
