Anticipating and Dissipating Disputes Using NJSAs. One creative way to use an NJSA may be in cutting off disputes before they occur. That is exactly what testators seek to accomplish in antemortem probate proceedings1. In short, antemortem probate is a judicial proceeding in which an interested person seeks a declaratory judgment confirming the validity of a testator’s last will and testament while the testator is still alive. If the proceeding is successful, then upon the testator’s death, her will must be admitted to probate. The procedure provides some certainty to the testator that her last will and testament will be shielded from challenges after she dies. In the same way that antemortem probate provides this certainty, an antemortem NJSA may provide certainty for a settlor that her trust agreement will not be subject to litigation.

  • Resolution of Claims and Disputes 4.4.1 The Architect will review Claims and take one or more of the following preliminary actions within ten days of receipt of a Claim: (1) request additional supporting data from the claimant, (2) submit a schedule to the parties indicating when the Architect expects to take action, (3) reject the Claim in whole or in part, stating reasons for rejection, (4) recommend approval of the Claim by the other party or (5) suggest a compromise.
