Common use of Applicable Laws and Disputes Resolution Clause in Contracts

Applicable Laws and Disputes Resolution. 6.1 The execution, validity, interpretation, performance and disputes resolution shall be governed by and interpreted in accordance with the law of the People’s Republic of China. 6.2 Any disputes arising from this agreement shall be first settled through the friendly consultation; in case of no settlement amicably as aforesaid, shall be handled over to Shanghai Arbitration Committee and finally resolved by arbitration in accordance with its existing valid arbitration rules in Shanghai. The arbitration award shall be final and binding upon all the parties.

Where the dispute cannot be resolved by negotiation, either party may submit the dispute for arbitration in Shenzhen to Shenzhen Court of International Arbitration in accordance with its existing valid arbitration rules then in Shanghaiforce. The arbitration award shall be final and binding upon all the parties.
