Approval - delivery date. The Customer shall, prior to the end of the approval period, give the Contractor written notice as to the outcome of the checks, and confirming whether or not the operational services are deemed to be in conformity with the agreed and, consequently, whether or not they can be approved. If such notice has not been sent by the end of the approval period, the operational services shall nevertheless be deemed to be approved (through laches). The Customer may not refuse to approve the operational services on the basis of matters that are immaterial for purposes of the Customer’s use of the operational services. The approval criteria for the approval period shall be specified in detail in the activities and follow-up plan for the approval period. Unless other approval criteria are agreed in the activities and follow-up plan for the approval period, the following shall apply: The Customer shall have the right to reject the approval period if, during the final five (5) working days of the approval period, one or more critical incidents exist or have occurred, or if three or more serious incidents have occurred (see the classification of undesirable incidents in clause 2.2). If the Customer rejects the approval period, the approval period shall be extended until the terms and conditions for approval have been met. If, at the end of the approval period, the operational services have errors and deviations that would entitle the Customer to reject the approval period, the Customer may nevertheless choose to approve it with reservations. If the Customer chooses to approve the operational services with reservations and references to the agreed rectification plan, and the rectification plan is not complied with in respect of the errors that prevent approval, the remedies shall apply as if the approval period was extended (delay). The first working day after the operational services are, or are deemed to be, approved, is referred to as the delivery date. Errors that occur after the expiry of the approval period shall be handled as undesirable incidents pursuant to the procedures in clause 2.2.2.

  • Material Delivery Within 60 days after award date, Purchaser shall provide Forest Service a written schedule showing the desired delivery dates of any material to be supplied by Forest Service. With reasonable notice, schedule may be amended by agreement. Forest Service agrees to make delivery within 15 days after the scheduled delivery dates that are at least 60 days after the schedule is submitted, unless prevented by causes beyond control of Forest Service. If Purchaser does not provide Forest Service the written schedule within the period provided in this Subsection, Forest Service agrees to make delivery within 90 days after a late schedule is submitted, unless prevented by causes beyond control of Forest Service. After delivery to and written receipt by Purchaser, Purchaser is responsible for installation of needed material and for any loss of or damage to such material due to Purchaser's negligence prior to installation or return of unused material to Forest Service. At Purchaser’s option, Forest Service deliveries shall be to Purchaser’s storage area, as agreed, or to the nearest practicable point to the job site along existing roads. Unused material shall be returned to Forest Service at location of delivery, unless agreed otherwise.

  • Physical Delivery All notices must be in writing, except as provided in § 27.2. Any document, including a signed 698 document or notice, from or on behalf of Seller, and delivered to Buyer is effective when physically received by Buyer, any 699 signatory on behalf of Buyer, any named individual of Buyer, any representative of Buyer, or Brokerage Firm of Broker working 700 with Buyer (except for delivery, after Closing, of the notice requesting mediation described in § 23 and except as provided in 701 § 27.2).   • PRODUCT DELIVERY Delivery must be made as ordered to the address specified on the Purchase Order and in accordance with the terms of the Contract or Contract Award Notice. Unless otherwise specified in the Bid Documents, delivery shall be made within thirty calendar days after receipt of a Purchase Order by the Contractor. The decision of the Commissioner as to compliance with delivery terms shall be final. The burden of proof for delay in receipt of Purchase Order shall rest with the Contractor. In all instances of a potential or actual delay in delivery, the Contractor shall immediately notify the Commissioner and the Authorized User, and confirm in writing the explanation of the delay, and take appropriate action to avoid any subsequent late deliveries. Any extension of time for delivery must be requested in writing by the Contractor and approved in writing by the Authorized User. Failure to meet such delivery time schedule may be grounds for cancellation of the order or, in the Commissioner’s discretion, the Contract.

  • Personal Delivery When personally delivered to the recipient, notice is effective upon delivery.

Prior to selling, trading, exchanging, or otherwise conveying unprocessed timber sold under this contract to any other person, PURCHASER must first obtain a certification of the person's eligibility to purchase unprocessed State timber, and their intent to comply with the terms and conditions contained in OAR 629-031-0005 through 629-031-0045. The certification shall be made in a form and manner prescribed by STATE, and shall be forwarded to STATE upon completion of the transaction. Obtaining the certification shall not relieve PURCHASER of the responsibility to provide STATE with an accounting of the delivery destination of that timber.

  • Final Completion Date Final Completion for the Work as defined in Article 6.1.3 of the General Conditions to the Continuing Contract for Construction Management shall be achieved by September 30, 2022.
