ARTICLE TEMPORARY ASSIGNMENTS. Where an employee is assigned temporarily to perform the duties of a position in a classification with a higher salary maximum for a period in excess of five (5) consecutive working days, he or she shall be paid as if assigned to the first salary level of the higher classification from the day he or she commenced to perform the duties of the higher classification, provided that where such a change results in an increase of less than three percent he or she shall receive the next higher salary rate again. Acting pay shall not exceed the maximum of the salary range of the higher classification except where permitted by salary note. When an employee is temporarily assigned to the duties and responsibilities of a position in a classification with a lower salary maximum where there is not work reasonably available for him or her in the position from which he or she was assigned, he or she shall be paid the lower applicable classification rate to which he or she was assigned, after the expiration of ten consecutive working days in such lower classification. Where an employee requests or competes for a temporary assignment to a position in a classification with a lower salary maximum, he or she shall be paid the lower classification rate immediately upon commencement of the duties of the temporary assignment. When an employee is temporarily assigned to the duties and responsibilities of a position in a classification with a lower maximum salary where there is work reasonably available for him or her in the position from which he or she was assigned, he or she shall continue to be paid at the rate applicable to the classification from which he or she was assigned. This Article shall not apply to temporary assignments where an employee is temporarily assigned to perform the duties and responsibilities of another employee who is on vacation. An employee who has performed the full duties of such designated position in an acting capacity for a period of at least eighteen (18) months, shall receive one (1) month's notice before being reverted to the former position, and failing such notice, the acting salary will be continued for one month after the employee reverts to the former position. ARTICLE TEMPORARY ASSIGNMENTS. Where an An employee is temporarily assigned temporarily to perform the duties of a position in a another job classification with a higher salary maximum for a period of two (2) hours or more, excepting a temporary assignment resulting from shortage of work or disciplinary demotion, will receive the regular straight time hourly rate of the job classification to which he is assigned, or the regular straight time hourly rate of the job classification he previously held, whichever is the higher, except that this provision shall not apply to an employee receiving a Progression rate of pay, who shall, while performing such temporary assignment, continue to receive his Progression rate of pay, and not the rate for the job which might be greater, until such time that he has completed (36) months of active service. For the purpose of daily overtime, an employee temporarily assigned to a classification for more than four (4) hours in excess of five (5) consecutive working daysa day will qualify for available overtime in the assigned classification as the most junior employee in the classification. Having so qualified, he or she shall then carry his seniority to the assigned classification. However if the temporarily assigned employee does not qualify for such overtime, he shall then revert to his own classification for the purpose of daily overtime. An employee temporarily assigned to another job classification will be assigned for a period not exceeding (22) days. Providing the employees of the shift from which the assignment is made within the Distribution Centre concerned are relatively equal with respect to physical fitness, skill and ability, seniority within the classification from which the assignment is made, shall be paid as if the determining factor in such temporary assignment which shall be assigned on a daily basis. Once temporarily assigned, an employee may not use his seniority to claim subsequent temporary assignments during that day.
