Assignment of Subcontracts Upon Termination. Contractor shall include in each of the Material Subcontracts, and shall use commercially reasonable efforts to include in all other Subcontracts, a provision (i) permitting the assignment of such Subcontract to Owner or its designee without additional payment and (ii) requiring Subcontractor to perform the Work for Owner or its designee upon such assignment.
