Such statement shall include the grade and/or subject to which the professional employee desires to be made available reassigned, the school or schools to teachers with seniority rights who were not actively teaching which said employee desires to be transferred in the previous semesterorder of preference, and the reason or reasons for such reassignment or transfer.
5. Any classes remaining unfilled shall In making reassignments and transfers, the Superintendent will give consideration to the desires of the professional employee, to said employee's area of competence, major and/or minor field of study, quality of performance and length of service in the Attleboro School Department and to the needs of said Department. Before the end of each semester, the Director of Community Services, or his designee, will survey all teachers who are teaching to determine All bargaining unit members shall be provided their preference and number of classes they desire to teach assignment for the following semester.
B. The Xxxxxx/Xxxxxx-Xxxxxxxxx adult education program is committed to providing upcoming school year no later than August 1st. This will include location, hours per day, days per year, and grade level for inclusion. Should the very best education program to our communities; however, situations same position no longer be available or if that position has been eliminated or reduced by thirty (30) minutes or more per day the employee may rise where reductions in class offerings may be necessitated. Assignments for each program's semester shall be made according to choose one of the following procedureoptions:
1. Each teacher initially shall The employee may bump into another position in the paraprofessional unit, provided the paraprofessional has greater seniority than the individual being bumped, and provided the employee has the necessary qualifications and ability to perform the job. Any bargaining unit member that bumps into a Title I position must meet the qualifications of the No Child Left Behind Act. The parties recognize that there may be assigned certain elements of a position where additional training is required. If additional training is needed the same Board will provide such training, or
2. Apply for a vacancy.
B. All vacancies and newly created positions on the paraprofessional staff will be posted by the Personnel Office (at the personnel office and in a specified location in each school building) and copies sent to the Association President and to all members at home during the summer. This includes any position of more than four (4) weeks duration regardless of the number of classes scheduled hours worked. When substitutes are hired to fill paraprofessional positions of ten (10) days or more, the previous semester unless District shall notify the teacher elects Association President within three (3) working days of the substitute’s hire date.
C. When an opening for a paraprofessional position becomes available and is posted, the following shall apply:
1. All paraprofessionals applying within the posted period will be granted an interview. All paraprofessionals are encouraged to teach fewer classes or if fewer classes have been scheduledtrain and prepare for vacancies.
2. Should any teacher's classes not be available, said teacher, based upon seniority, shall have the first right of assignment to any unassigned classes for which he/she is qualified after C is met.
3. Should the teacher(s) still be unable to fill their previous load, then they shall have the right to select a class that they are qualified to teach from the lowest seniority teacher within their own program.
4. Any classes still unfilled The position will be made available to teachers with seniority rights who were not actively teaching filled by the previous semester.
5. Any classes remaining unfilled shall be made available to teachers teaching less than full time on the basis of seniority, assuming they are most qualified for the position.
6. Any classes remaining unfilled shall be made available to teachers teaching full time on the basis of seniority, assuming they are qualified for the position.
7. Remaining classes shall be posted in accordance with G below.
C. Any teacher who had an assigned class dropped the prior semester shall, by seniority, have first choice of unassigned classes during the next semester.
D. All assignments will depend on fundable student enrollment. Classes may be canceled up to the end of the count period for each respective class.
E. A vacancy is defined as any new or existing position to which no current employee is assigned. NOTE: Teachers hired to teach special funded programs will not be granted assignments as stated in B-1.
F. All vacancies shall be mailed to all members and posted internally and externally for a period of seven days before being permanently filled. Outside applicants will not be considered until the senior internal process has been completed.
G. Vacancies will be offered to applicants in the following order:
1. Qualified bargaining unit members within the program
2. Qualified bargaining unit members
3. Outside applicants
H. Vacancies shall be filled based upon seniority and qualificationscandidate. If two or more teachers apply for a position and all meet the posted qualificationsinternal candidates are equally qualified, the most senior candidate will be offered the position. If no internal candidate(s) is available, the most qualified external candidate will be offered the position. If the implementation of this provision becomes problematic for either party, both parties agree to renegotiate this issue only.
3. All interview committees shall include at least one member of the Association appointed by the president.
4. It is in the interest of both parties to recognize that the affected position begins as quickly as possible after the interviews.
D. No vacancy shall be first offered filled, except on a temporary basis in case of emergency, until such vacancy shall have been posted at least five (5) school days from the date of distribution during the school year and within ten (10) calendar days from the date of distribution during the non-school months. In the event an employee is absent during the posting period, and desires to apply for the vacancy, the Association President or designee may submit an application on the employee’s behalf during the five (5) or ten (10) day posting period.
E. Notification of all appointments shall be sent to the teacher with President of the greatest seniorityAssociation by the Assistant Superintendent of Human Resources following the appointment.
I. Teachers hired F. The parties recognize the importance of providing training to fill vacancies created by an approved leave new paraprofessionals or existing paraprofessionals who accept different positions within the District. The Board agrees that when a paraprofessional transfers to a new position, the supervising administrators will work cooperatively to ensure a smooth transition. After the transfer, the new paraprofessional will be given the opportunity to train with a paraprofessional knowledgeable of the position requirements. Additional training will be addressed whenever necessary.
G. Once a position is filled, the parties agree that the hours shall not earn differ from the hours posted for a period of thirty (30) calendar days. At that time, if the position is increased by thirty (30) minutes or more, the Association President shall be notified of the change and the job rights under "B" abovewill be reposted according to the contract.
J. No teacher shall be able H. It is understood that employees with five (5) or more years of building seniority, if displaced, may elect to select a class from a lower stay within the school building that they have been assigned. Seniority permitting, displaced employee may exercise their seniority teacher after one week prior to by bumping the start of the semester.
K. By mutual agreement between the Director of Community Services, or his designee, and the teacher, a class taught during the survey semester may not be offered the following semester. However, said teacher shall earn job rights, as in "B", for the semester following the semester in which the class was canceled.
L. As a courtesy, posting for certified educational position vacancies least senior person with equivalent hours in the regular programs of the Xxxxxx and Xxxxxx-Xxxxxxxxx school districts shall be made available to bargaining unit members whenever possiblebuilding.

K. By mutual District. Since students are entitled to be taught by employees who are working within the area of their competence, employees shall not be assigned or transferred outside the scope of their area of qualification. Provided, however, this provision may be waived for good cause upon written agreement between of the Director of Community Services, or his designeeFederation and the School District. The District will review a tentative draft specials schedule with the Federation President, and a specials employee designated by the teacherFederation, a class taught during to obtain the survey semester may not Union’s input prior to publishing the schedule. Under normal circumstances, the draft schedule will be offered reviewed with the following semesterFederation on or before the last employee workday in June. However, said teacher shall earn job rights, as in "B", for the semester following the semester in which the class was canceled.
