Authority commitments. Unless otherwise set out in the Commercial Schedule, the Supplier acknowledges that: there is no obligation on the Authority or on any other Participating Authority to purchase any Goods or Services from the Supplier during the Term; no undertaking or any form of statement, promise, representation or obligation has been made by the Authority and/or any other Participating Authority in respect of the total quantities or volumes or value of the Goods or Services to be ordered by them pursuant to this Framework Agreement and the Supplier acknowledges and agrees that it has not entered into this Framework Agreement on the basis of any such undertaking, statement, promise or representation; in entering this Framework Agreement, no form of exclusivity has been granted by the Authority and/or other Participating Authority; and the Authority and/or other Participating Authorities are at all times entitled to enter into other contracts and agreements with other suppliers for the provision of any or all goods or services which are the same as or similar to the Goods or Services.

2.1 Unless otherwise set out in the Award Schedule, the Supplier acknowledges that:
2.1.1 there is no obligation on the Authority or on any other Participating Authority to purchase any Goods from the Supplier during the Term;
2.1.2 no undertaking or any form of statement, promise, representation or obligation has been made by the Authority and/or any other Participating Authority in respect of the total quantities or value of the Goods to be ordered by them pursuant to this Framework Agreement and the Supplier acknowledges and agrees that it has not entered into this Framework Agreement on the basis of any such undertaking, statement, promise or representation;
2.1.3 in entering this Framework Agreement, no form of exclusivity has been granted by the Authority and/or other Participating Authority;
2.1.4 the Authority and/or other Participating Authorities are at all times (including during the Term of this Framework Agreement) entitled to enter into other contracts and framework agreements with other suppliers and/or the Supplier for the provision of any or all goods which are the same as, equivalent, partially equivalent or similar to the Goods; and
2.1.5 the Authority shall have no liability to it in respect of or arising out of the volume of Orders received by the Supplier during the continuance of this Framework Agreement.

2.1.1 there is no obligation on the Authority or on any other Participating Authority to purchase any Deliverables from the Suppliers during the Term;
2.1.2 that this DPS Framework Agreement is a multi-operator framework and that Call- Off Contracts will only be awarded based upon the outcome of a Competition;
2.1.3 no undertaking or any form of statement, promise, representation or obligation has been made or given by the Authority and/or any other Participating Authority in respect of the total quantities or volumes or value of the Deliverables to be ordered by them pursuant to Call-Off Contracts awarded pursuant to this DPS Framework Agreement and that the Suppliers have not been provided with or offered any form of exclusivity in relation to Orders for Deliverables and the Suppliers acknowledge and agree that they have not entered into this DPS Framework Agreement on the basis of any such undertaking, statement, promise, representation or obligation;
2.1.4 in entering this DPS Framework Agreement, no form of exclusivity has been granted to the Suppliers by the Authority and/or any other Participating Authority; and
2.1.5 the Authority and/or other Participating Authorities are at all times entitled to enter into other contracts and agreements (including framework agreements) with other suppliers for the provision of any or all deliverables which are the same as or similar to the Deliverables.

3.1.1 there is no obligation on the Authority or any Participating Authority to purchase any Services from the Provider during the Term;
3.1.2 no undertaking or any form of statement, promise, representation or obligation has been made by the Authority and/or any Participating Authority in respect of the total volumes or value of the Services to be ordered by them pursuant to this Framework Agreement and the Provider acknowledges and agrees that it has not entered into this Framework Agreement on the basis of any such undertaking, statement, promise or representation;
3.1.3 in entering this Framework Agreement, no form of exclusivity has been granted by the Authority and/or any Participating Authority;
3.1.4 the Authority and/or any Participating Authority is at all times entitled to enter into other contracts and agreements with other suppliers for the provision of any or all services which are the same as or similar to the Services; and
3.1.5 the Authority may inform the Provider at the commencement of this Framework Agreement that a specific range of Services is likely to be the focus of call-off arrangements in the period following the Commencement Date but that this does not in any way prevent a Participating Authority from calling-off any Services later during the Term.
