Authorized Transmission Agent. Provider acknowledges that Google may use, and such use shall be permitted hereunder, Akamai Technologies, Inc., Limelight Networks, Level3 Communications or a similarly capable Google content delivery network (“Authorized Transmission Agent”) in the delivery of the Provider Channel Content to users of the Google Services and/or YouTube Service; provided that, under no circumstances shall Google be liable for any damages caused by a third party Authorized Transmission Agent’s failure to comply with the applicable WB Content Security Rules set forth in Schedule 2, unless such third party Authorized Transmission Agent’s failure (i) is directly due to Google, and (ii) results in a third party’s unauthorized access to the Provider Channel Content.
